<br />probate thereof, as the same is on file and of record in the County Court in Butler County,Nebra.ska.

<br />of Final Decree.
<br />Martha E.Allen, Deceased.
<br />Now on this 27th day of March, 1942, at the hour of ten o'clock A.M. this matter came on to be
<br />heard upon the petition for final settlement, the final report, order for hearing thereon and
<br />notice thereof, together with the records, files and the evidence and the court being fully in-
<br />formed finds:
<br />1. That Martha E.Allen died testate, a resident and inhabitant of Butler County, Nebraska, on
<br />the 23rd day of October, 1940.
<br />2. That upon petition, order and notice duly given the instrument filed in said court on the
<br />28th day of October, 1940, was duly admitted to probate and probated as and for the last will and
<br />testament of said decedent, on November 22, 1940.
<br />3. That Mabel C.Mahlin named as executrix in said will was duly appointed as such executrix
<br />by letters testamentary issuing out of this court on the 22nd day of November, 1940.
<br />4. That more than sixteen months have elapsed since the appointment of said executrix and that
<br />all claims filed against said estate have been duly allowed and paid and all claims, if any, not
<br />filed and allowed have been fo -ever barred in manner and form as provided by law.
<br />5. That said deceased at the time of her death was survived by Mabel C.Mahlin who is a
<br />daughter of said deceased and as such her sole and only heir at law said decedent having been
<br />predeceased by her husband and died a widow and was not by other child or child or children of
<br />a. predeceased child survived.
<br />6. That said deceased disposed of all of her estate whereof she was possessed at the time of
<br />her death by said last will and testament so as aforesaid admitted to probate herein.
<br />7. That under the "Second" provision of said last will and testament of said deceased she
<br />gave, devised and bequeathed unto Mabel C.Mahlin the East 70 feet of Lot Six and the east 70 feet
<br />of the South -half of Lot Three, all in Block Four (4) Miles First Addition to the city of David
<br />City, Nebraska, absolutely forever and same should be accordingly assigned herein.
<br />That under the "Third" provision of said last will and testament of said deceased she gave
<br />devised and bequeathed unto Mabel C.Mahlin an undivided one -half interest in and to all of the
<br />North -west Quarter of Section Thirty -three (33) Township Nine (9), Range Seventeen (17) West of
<br />the 6th P.M. in Buffalo County, Nebraska, absolutely forever and same should be assigned accordingly
<br />herein.
<br />9. That under the "Fourth" paragraph of said last will and testament was given, devised and
<br />bequeathed unto Mabel C.Mahlin U.S.Savings Bonds numbere. D65262 and D65261 Series A due March 1945,
<br />also an undivided one -half interest in and to Bonds No. 236, 237 and 238 Epply Hotel Company of
<br />Omaha, Nebraska, absolutely forever; that said Savings bonds have been reissued under order of
<br />this court and are now properly registered in the name of Mrs.Mabel C.Mahlin as numbers D192135
<br />and D192136 Series A due March 1945 in full of her bequest with respect to same and said Epply
<br />Hotel Company Bonds No. 236, 237 and 238 duly assigned and delivered over to said Mabel C.Mahlin
<br />in full of her bequest thereof and same should be so decreed herein.
<br />10. That under provision "Fifth" of the last-will and testament of said deceased, Lucile
<br />Price was given devised and bequeathed, the Northwest Twenty acres of the West -half of the South-
<br />east Quarter of Section Seventeen (17), Township Fifteen (15) north,Range One (1) East of the 6th
<br />P.M. in Butler County, Nebraska, also the Southwest Quarter of the Northwest Quarter of Section
<br />Twenty -three (23) Township ifteen (15) north,Range One (1) East of the 6th P.M. in Butler County,
<br />Nebraska; also Lot Six (6) in Block Eleven (11) in Clark's Addition to the City of Grand Island,
<br />Nebraska; also U.S.Savings bonds numbered D65259 and 65260 Series A due March 1945 absolutely
<br />forever; that all of said real estate should be assigned accordingly and the court speci&lly finds
<br />that U.S.Savings bonds have been reissued in the name of Luci1:Price as numbers D192133 and
<br />D192134 Series A due March, 1945 in full of her bequest with respect to same and have been deliv-
<br />ered over to her by executrix herein.
<br />11. That under provision "Sixth" of said last will and testament of said deceased Mildred
<br />Lnenicka and Marion Mahlin were given, devised and bequeathed the Northeast Quarter of Section
<br />Twenty -three (23), Township Sixteen (16) North,Range One (1) East of the 6th P.M. in Butler
<br />County, Nebraska, share and share alike; also U.S.Savings Bonds Numbered D65258 and D6525I and
<br />D65256 and D65255 Series A due March 1945; that said real estate should be so assigned share and
<br />share alike in undivided interest and said U.S.Bonds have been reissued pursuant to order of this
<br />court Bonds number D192129 and D192130 Series A due 1945 in the name of Mr. Marion Mahlin and Bonds
<br />number D192131 and D192132 Series A due March 1945 to Mrs. Mildred Lnenicke in full of their
<br />respective bequest to same and. have been delivered over to each by said executrix herein.
<br />12. That under provision "Seventh" The Lincoln Telephone Telephone and Telegraph Company
<br />stock represented by Certificate No. 1816 for forty shares have been given and devised under said
<br />will to Mabel C.Mahlin, Lucile Price, Mildred Lnenicka acid Marion Mahlin absolutely forever, share
<br />and share alike or each an undivided one - fourth interest and same should be assigned accordingly.
<br />13. That under provision Eighth of said last will and testament there was given and devised
<br />unto Nellie Houdescheldt the sum of 4250.00; that said bequest has been duly paid and satisfied
<br />by said. executrix as evidenced by receipt filed herein.
<br />14. That under provision ninth of said last will and testament of said deceased all the rest,
<br />residue and remainder of the real and personal property of every kind and nature and wheresoever
<br />situated is given, devised and bequeathed unto Mabel C.Mahlin, Lucile Price, Mildred Lnenicka and
