<br />and testament, and the uncertainty as to what such values may be at the time provided for the
<br />payments aforesaid, the said Walter Quandt, Reinhardt Quandt and Arthur Quandt are unwilling to
<br />accept such remainder interests in said real estate at the present time, but reserve the right
<br />to accept or reject the same after the death of the said Metta Quandt, and within the time fixed
<br />for said payments under the terms of said last will and testament,.or at such prior time as they
<br />may by law be required to accept or- reject the same, and subject to such adjustment as may be
<br />required in the payment and distribution of said fund by reason of the fact that the said North-
<br />east Quarter of Section 2, Township 12, North Range 9, Hall County, Nebraska, is subject to a
<br />mortgage in the principal sum of $6000.00, placed thereon subject to the execution of said last
<br />will and testament.
<br />IT IS THEREFORE ORDERED AND DECREED by the Court that the final report of the said Executor be
<br />and the same is hereby approved and confirmed and the said Executor discharged from his trust,
<br />upon payment of the widow's allowance aforesaid, and that the real estate above described be
<br />and the same is hereby assigned and distributed to the said Metta Quandt for and during her
<br />natural life, with remainder, subject to the terms and provisions of the said will, as follows:

<br />the 6th P.M., Hall County, Nebraska.

<br />On this !4 day of March,1!342,this cause came on for hearing upon the Final Report of Maria T.
<br />Ewing,administratrix of the estate of Edward F.Ewing,deceased,and upon her petition for settle-
<br />ment of said estate and discharge therein.And the Court being duly advised in the premises,and
<br />having examined the records and files finds that du-e and legal notice has been given to all
<br />persons interested in said estate of the time and place Fixed for hearing upon said estate as
<br />heretofore ordered by'the Court.
<br />And no one appearing to object to said report,and the Court having examined same together with
<br />vouchers on file,and the testimony offered in support thereof,and being duly advised in the prem-
<br />ises,f nds that said report is -true and correct in all things and that the same ought to be
<br />all-owed and approved as and for the final report of said admjnistratrix.
<br />The Court finds that the said Edward F.Ewing departed this life on the 11th day of April,1941,
<br />and at the time of his death the said Edward F.Ewing was a resident and inhabitant of Hall County,
<br />Nebraska. The Court further finds that the said Edward F.Ewing also went by the name of Edward
<br />Ewing,Edward E.Ewing,Edwin Ewing,Edvrin E.Ewing and Edwin F.Ewing,but that his true and correct
<br />name was Edward F.Ewing.
<br />The Court further finds that due and legal notice h -as been given to all persons of the time and
<br />place fixed by the Court for the presentation of claims against said estate,and that the time so
<br />fixed by the Court has fully expired and that all persons having claims against said estate,if
<br />any such there be,are forever barred and excluded from setting up or asserting any such claims
<br />against said estate.
<br />The Court finds that said administratrix has received from all sources the sum of $1969.00 and
<br />after paying the claims against said estate,the funeral expenses and costa of administering said.
<br />estate,that there is no money remaining in her hands for distribution to the heirs at law.
<br />The Court finds that the said Edward F.Ewing,deceased.left surviving him Maria T.Ewing,widow,
<br />Thorias R.Ewing,l�ae Ewing Powers, William E.Ewing and Voward Ewing,sons and daughter of said deceas-
<br />ed,all being of legal age.
<br />The Court further finds that the said Edward F . Ewing,deceased,died seized in fee simple of the
<br />following described real estate,to -wit;
