<br />of northeast corner; thence south along east line 3001; west of right of way; north along right
<br />of way 300' east to beginning.
<br />That said executor has on hand personal property for distribution as follows:
<br />The sum of $13.70.
<br />A small amount of wheat in the Hayland or Prosser Elevator
<br />First mortgage note in sum of $10,000.00, dated October 23, 1931, signed by Ekko Lieken and
<br />Anna Dieken, husband and wife, secured by mortgage on real estate.
<br />Note and mortgage in the sum of $2172.25, dated September 25, 1936, signed by Percy M.Wells
<br />and Elsa Wells, husband. -land wife, secured by mortgage on real estate.
<br />Note and mortgage in the sum of $827.75, dated September 28, 1936,signed by Lester F.Wells and
<br />Della Mae Wells, husband and wife, secured by mortgage on real estate.
<br />The court further finds that the said. executor, as shown by the records and files in this
<br />case, and upon order and direction of this court, accepted deed and acquired title to
<br />Southwest Quarter (SWJ) of Section Thirty -three (33),Township Nine (9),North Range Eleven
<br />(11), West of the 6th P.M., Hall County, Nebraska,
<br />in settlement of a note and mortgage signed b John F.Uden and Anna A.Uden; and that said executor
<br />foreclosed a note and mortgage in the sum of 6000, signed by Gustav Lambrecht and Emilie Lambrecht,
<br />and at the foreclosure sale bid in, acquired, and became the owner and holder of the
<br />South Half (Slff) of the Southwest Quarter (SWJ) and the Northwest Quarter of the Southwest
<br />Quarter (SWJ) of Section Twenty -seven (27), Township Nine (9),North,Ra.nge Eleven (11), West of
<br />the 6th P.M., Hall County, Nebraska;
<br />and that the said executor has not sold said above described real estate, and that said real estate
<br />should be treated, assigned and distributed as a part of the personal estate of said deceased, as
<br />provided by law.
<br />That the only heirs at law and next of kin, devisees, legatees and beneficiaries under the
<br />last will and testament of said deceased, are as follows:

<br />That due and legal notice to creditors has been give; that all claims g1lowed against said
<br />estate have been fully paid and. satisfied; that said estate is now solvent, and that it is not
<br />subject to either State or Federal inheritance tax; that the report of the executor heretofore
<br />filed is in all respects just, true and correct; that all money received and paid out has been
<br />properly accounted for; that all of the above described property which said executor now has
<br />on hand, should be assigned and distributed as provided by the terms of the aforesaid last will
<br />and testament of Rimt H.Dieken, deceased.
<br />IT IS THEREFORE CONSIDERED, 01DERED, ADJUDGED AND DECREED BY THE COUNT that the final account
<br />of the said J.Fred Ernstmeyer, executor of the estate of Rimt H.Dieken, deceased, should be and
<br />the same is hereby in all things aporoved, confirmed and allowed; that all of the personal property
<br />remaining in the hands of said executor, including the sum of 013.70, a small amount of wheat in the
<br />Hayland or Prosser Elevator, the notes and mortgages hereinbefore described, and the
<br />Southwest Quarter (SW14) of Section Thirty -three (33), Township Nine (9);North Range
<br />Eleven (11), West of the 6th P.M., Hall County, Nebraska.
<br />South Half (S2) of the Southwest quarter (SWJ) and the Northwest Quarter (NWJ) of the
<br />Southwest Quarter (SWg) of Section Twenty -seven (27),Township Nine (9),North,Ra.nge Eleven
<br />(11),West of the 6th P.M., Hall County, Nebraska,
<br />should be and are hereby assigned to Marg retha Dieken, widow of said deceased.
<br />That a life estate in and to the real property of which said deceased died seized and possessed,
<br />hereinbefore described, should be and is hereby assigned to Margretha. Dieken, widow, of said
<br />d- ceased, under the terms and conditions as set out in the aforementioned last will and testament
<br />of said deceased.
<br />That subject to the life estate as aforesaid, hereinbefore assigned to Margretha- Dieken, widow
<br />of said deceased, the above mentioned and described real estate of which said deceased died seized
<br />and possessed, should be and is hereby assigned to
