A Ck IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA DECREE Now,on this 28th day of February,1942,this cause came on for hearing upon the petition of Ernest W.Augustine,pr,aying for the settlement of the estate of the said Solon Wells,deceased.,for a de- termination of his heirship and the right of descent of his real estate,and the degree of kinship of his heirs.at law,and a decree settling his estate,and it appearing to the Court from the proof on file herein that due and legal notice has been given by publication for three successive weeks, as by law and the order of this court provided,to all creditors,heirs at law,and other persons interested in said estate,of the filing of said petition and of the time and place fixed for the hearing of the same,and there being no objections thereto,this cause was duly submitted to the Court upon the petition and the evidence in support thereof,and the Court being fully advised in the premises finds that the allegations of said petition are true,and that said petitioner, Ernest W.Augustine,has purchased the real estate hereinafter described and is the owner thereof, and that he is a competent and proper person to proseeute this proceeding ;that the said Salon Wells departed this life intestate at Wood River,in Hall Cbunty,Nebraska,on the 15th day of July 1933,and at the time of his death he was a resident and inhabitant of Hall County,Nebraska,that he died seized the owner of the following described premisee,to -wit: Lots Two (2),and Five (5),and the Southeast Quarter of the Northwest Quarter (SEJNW J),and,Lote Three (3) and Four (4),on Island,all in Section Nineteen (19),Township Nine (9),North,Range Eleven (11),West of the 6th P.M., and Lots Four (4),Five (5),and Six (6),and the Northeast Quarter of the Southeast quarter (NE4 SEI) in Section Twenty -four (24),and Lot 1 on Island, in Section 25,Township 9,North Range 12,West of the th P.M.'(Excepting one half acre (J) heretofore conveyed to School District #20 of Hall County,Nebraska), that more than two years have elapsed since his death ;that no application has ever been made in the State of " ebraska for the appointment of an administrator of his estate,and no petition has been filed for that purpose,and no administration has ever been had upon the estate of the said Solon 'Welle,deceased, The Court further finds that the said Solon Wells left surviving him as his heirs at law and his only heirs at law the following named per.sone,to -wit: Hannah C.Wells,his widow,and Stanley Wells, his son,both residing in Wood River,Hall County,Nebraska,both of whom are of legal age. The Court further finds that under the laws of the State of Nebraska,in force at the time of the death of the said Solon Welle,the real estate hereinbefore described passed and descended,by absolute title,share and share alike to the said Hannah C.Welle,his widow,and Stanley Wells,his son. The Court further finds that the funeral expenses of said deceased have been fully paid and that all debts of said deceased and of his estate,if any such existed,are forever barred and precluded, and that the costs of these proceedings have been paid. IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that the said Solon Wells died intestate in Hall County,Nebraska,on the 15th day of July,1933,that more than two years have elapsed between the death of the said Solon Wells and the filing of this petition,that no application for the appointment of an administrator of his estate has been made,nor has there ever been any administration upon his estate in the State of Nebraska;that said deceased died seized as the owner of the real estate hereinbefore described situated in Hall County,Nebraska,that the petitioner is a competent and qualified person to proseeute this proceeding,that said deceased left surviving him as his heirs at law,and his only heirs at Iavy,Hannah C.Wells,his widdw,and Stanley Wells, his son,that upon the death of the said Solon Wells the real estate hereinbefore described passed and descended by absolute title,under the intestate laws of the State of Nebraska in force at the time of the death of the said Solon Wells,to Hannah C.Wells and Stanley Wells,widow and son of said deceased,in equal shares to each subject,however,to the homestead rights of the said Hannah C.Wells in and to said premises;that the said Solon Wells was a resident and inhabitant of Hall County on the date of his death. IT IS FURTHER ORDERED,ADJU DGED,AND DECREED BY THE COURT that all debts of said deceased and of his estate,if any such there Were,are forever barred and precluded,and that further administration of the estate of said deceased is hereby dispensed with and said estate is finally settled and forever closed.
