and correct and should be allowed as the final account of said Executor.
<br />The court further finds that at the time of the death of said deceased, he was the owner of the
<br />followin, described real estate, to -wit: East half of the Northwest Quarter, and East half of the
<br />Southwest Quarter, all in Section 33, Township 12 North, Range Nine,(9) West of the 6th P.M. in
<br />Hall County, Nebraska, and the West half of the Northwest of Section 33, Township 12 North,Range
<br />9, West of the 6th P.M. in Hall County, Nebraska. That said real estate should be assigned to
<br />the devisees under the will of the deceased according to its terms. That said West half of the
<br />Northwest Quarter of said Section 33, had been sold by the deceased to Donald W.Haggart under a
<br />contra0twhich had not been completed. That in order to complete the said contract, all of the
<br />heirs and devisees of the deceased have executed a deed to said real estate to the said Donald
<br />W.Haggart, and there is due from him the sum of 41975.00. That, for the purpose of perfecting an
<br />amicable settlement of said estateiit has been stipulated and agreed by all parties interested that
<br />the note and mortgage for said sum of $1975.00 be made to Agnes A.Haggart, which stipulation is
<br />approved and confirmed.
<br />That said executor has no property on hands belonging to said estate except the aforesaid note
<br />and mortgage and said real estate. That said deceased died on the 27th day of April, 1941, leav-
<br />ing a last will and testament which was duly admitted to probate in these proceedings on the 28th
<br />day of May, 1941. That, under the terms of said will, all the property of said estate passes to
<br />the children of said deceased, in equal shares, subject to the use thereof by Agnes A.Haggart,
<br />widow of the deceased, during her lifetime. That said deceased left surviving him, the said Agnes
<br />A.Haggart, his widow, Donald W. Haggart, a son, Ruth E. Laughlin, a daughter, and Stella E. Hansen,
<br />described.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED:
<br />That all claims against said estate be, and they are forever barred;
<br />That said final account of said Donald W.Haggart, Executor, be and the same is hereby approved
<br />and allowed as the Final Account of said Executor.
<br />That the within described real estate be, and the same hereby is assigned to said devisees under
<br />the terms of said will as of the date of the death of said deceased, and subject to the proceed-
<br />ings for the completion of the contract of sale to Donald W.Haggart as heretofore described;
<br />That said Executor assign to the respective new owners of said real estate the certificates of
<br />stock held by the deceased in the Elba National Farm Loan Association numbered 98 and 244 issued
<br />in connection with Federal Land Bank loans;
<br />That said Executor turn over to said Agnes A.Haggart the note and mortgage for $1975.00 hereto-
<br />fore described, and in accordance with the stipulation of parties.
<br />Said Executor having faithfully completed his duties as Executor., he is ordered to continue as
<br />Trustee of the estate under the terms of the will, paying the net profits therefrom to Agnes A.
<br />Haggart during her life time.
