<br />FRANKLIN S.TAYLOR, Deceased. )
<br />Now, on this 8th day of January, 1942, this cause came on for hearing upon the petition of
<br />Anna E.Baldwin, praying for the settlement of the estate of said deceased, for a determination of
<br />his heirship and the right of descent of his real estate, and the degree of kinship of his heirs
<br />at law, and a decree settling his estate, and it appearing to the Court from the proof on file
<br />herein that due and legal notice has been given by publication for three successive weeks, as by
<br />law and the order of this court provided, to all creditors, heirs at law, and other persons in-
<br />terested in said estate, of the filing of said petition and of the time and place fixed for the
<br />hearing of the same, and there being no objections thereto, this cause was duly submitted to the
<br />Court upon the petition and the evidence in support thereof, and the Court being fully advised in
<br />the premises finds that the allegations of said petition are true, and that said petitioner, Anna
<br />E.Baldwin, is one of the present owners of the real estate hereinafter described, and is a com-
<br />petent and proper person to prosecute this proceeding; that the said Franklin S.Taylor departed
<br />this life intestate in Hastings, Adams County, Nebraska, on the 6th day of January, 1938, and at
<br />the time of his death he ? ,,las a resident and inhabitant of Adams County, Nebraska, that he died
<br />seized as the owner of an undivided one -half interest in Lot Four (4), Block One Hundred Thirty -
<br />two (132) in Koenig & Wiebe's Addition in the Original Town, now city of Grand Island,Nebraska;
<br />that more than two years have elapsed since his death; that no application has ever been made in
<br />the State of Nebraska for the appointment of an administrator of his estate, and no petition filed
<br />for that purpose, and no administration has ever been had upon the estate of the said Franklin $.
<br />Taylor, deceased.
<br />The Court further finds that the said Franklin S.Taylor left surviving him as his heirs at
<br />law and his only heirs at la.w the following named persons, to -wit: Maude E.Taylor, his widow,
<br />and James N.Taylor, his son, both residing in Hastings, Adams County, Nebraska, both of whom are
<br />of legal age.
<br />The Court further finds that under the laws of the State of Nebraska, in force at the time of
<br />the death of the said Franklin S.Taylor, the real estate hereinbefore described passed and des-
<br />cended, by absolute title, share arid share alike to the said Maude E.Taylor and James N.Taylor,
<br />surviving widow. and "son of.Franklin.S.Taylor, deceased.
<br />The Court further finds that the funeral expenses of said deceased have been fully paid and
<br />that all debts of said deceased and of his estate, if any such existed, are forever barred and
<br />precluded, and that the costs of these proceedings have been fully paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED BY THE COURT that the said Franklin S.Taylor
<br />died intestate in Adams County, Nebraska, on the 6th day of January, 1938, that more than two
<br />years have elapsed between the death of the said Franklin S.Taylor and the filing of this petition,
<br />that no application for the appointment of an administrator of his estate has been made, nor has
<br />there ever been any administration upon his estate in the State of Nebraska; that said deceased
<br />died seized as the owner of the real estate hereinbefore described situated in Hall County, Ne-
<br />braska, that the petitioner is a competent and qualified person to prosecute this proceeding, that
<br />said. deceased left surviving him as his heirs at law, and his only heirs at law, Maude E.Taylor
<br />his widow and James N.Taylor, his son; that upon the death of the said Franklin S.Taylor the
<br />real estate hereinbefore described passed and descended by absolute title, under the interstate
<br />laws of the State of Nebraska in force at V e time of the death of the said Franklin S.Taylor,
<br />to Maude E.Taylor and James N.Taylor, widow and son of said deceased in equal shares to each.
