<br />On this 7th day of January, 1942, at 10 a.m., being continued to this date from the 20th day of
<br />December, 1941 at 10:00 o'clock A.M., this matter comes on for hearing upon the Final Account of
<br />the Administrator and for Final Settlement of the estate and discharge of Administrator. The whole
<br />matter coming on before the Court for final determination, the Court being fully advised and informed
<br />In the premises finds:
<br />1. That due and legal notice of the time and place for this hearing has been given to all persons
<br />interested by publication as provided by law, and proof of said publication is on file herein.
<br />2. That John S.Nicholls, also known as J.S.Nicholls, departed this life intestate on August 20,
<br />1940, being at the time of his death a resident and inhabitant of Adams County, Nebraska, and the
<br />owner of real and personal property located therein.
<br />3. That on September 9, 1940, a petition was filed in this Court by the widow and Children of
<br />the deceased, praying for the appointment of Earl L.Hunter, as Administrator of said Estate and for
<br />administration proceedings in said matter. That on September 28, 1940, after Notice of Hearing
<br />thereon had been duly given by publication according to law, an Order was entered directing that
<br />Letters of Administration be issued to Earl L.Hunter as Administrator upon his taking the oath
<br />required by law and filing bond in the penal sum of $2000.00 to be approved by the Court.
<br />4. That on the 28th day of September, 1940, said Earl L.Hunter duly qualified as Administrator
<br />by filing his oath and bond, whereupon letters of Administration were issued to him on September
<br />28, 1940 and ever since said date he has been the duly appointed, qualified and acting administrator
<br />of said estate.
<br />5. That on September 28, 1940 an order was duly entered by the Court fixing October 30,1940
<br />and. February 4, 1941 at 10 :00 A.M., at the County Court Room in Hastings, Adams County, Nebraska,
<br />as the time and place of hearings on claims against said estate and that all claims must be filed
<br />in said court on or before February 4, 1941, or'be forever barred. That notice thereof was duly
<br />given to all creditors of said estate by publication according to law,and that Proof of Publication
<br />is on file, herein.
<br />6. That the time limited for filing said claims has long since expired, and no claims whatsoever
<br />have been filed. That all claims not filed within the time limited for the same should be forever
<br />barred.
<br />7. That said John S.Nicholls left surviving as his sole and only heirs at law, the following
<br />named persons to -wit:
<br />Elizabeth J.Nicholls, widow, Kenesaw, Nebraska.
<br />Carrol C.Nicholls, son, Lincoln, Nebraska.
<br />Garnet E. Guilkey, daughter, Kenesaw, Nebraska.
<br />That said deceased left no other child or children, or the issue of any deceased child or
<br />children him surviving.
<br />8. That said deceased died seined and possessed, not only of the Sandow and haverly real estate
<br />mortgages and the Robertson and Stright notes set forth specifically on Page 2 of Inventory but
<br />also died seized and possessed of the real estate and mortgages set forth in the listings attached
<br />to Inventory and set forth in appraisement of Inheritance tax appraiser.
<br />Specifically the real estate in Nebraska of which said John S.Nicholls died siezed and possessed
<br />is as follows:
<br />Lot 9, County tax subdivision of Lots 3, 4, and 5, and South half of the Southwest Quarter of
<br />Section 25, Township 9, North of Range 12, West of the 6th P.M. containing 80 acres more or less
<br />according to the recorded plat of said Lot 8, and being on the south side of the south channel of
<br />the Platte River, Hall County, Nebraska.
<br />North Half of the Northwest Quarter of Section 1, Township 6, North,Range 9, West of the 6th P.M.,
<br />Clay County, Nebraska.
<br />Lot 2, Dietrich's Addition to Hastings, Nebraska.
<br />Northeast Quarter of section 29, Township 6,North,Range 11,West of the 6th P.M.,Adams County,
<br />Nebraska, except the N1 of NEI of SEI of said NEI of said Section which is used for Cemetery
<br />purposes.
