)
Mattheus Rauert, Deceased. )
This cause came on for hearing upon the final report and petition for settlement of Richard
Rauert, Executor, and upon his application for discharge.
The Court, having examined said report and the records and files in said estate and being
duly advised in the premises, finds that due and legal notice has been given to all persons in-
te -ested in said estate of the time and place fixed for hearing upon said final report, as hereto-
fore ordered by the court, and no one appearing to object to said report, the Court examined the
same, together with the vouchers on file and testimony in support thereof, and being duly advised,
finds that said report is true and correct in all things and ought to be approved and allowed as
and for the final report of said executor.
The Court finds that said Mattheus Rauert died on the 21st day of June, 1941, and at the time
of his death he was a resident and inhabitant of Hall County, Nebraska.
The Court finds that on June 30, 1941, a petition was filed herein, praying for the allowance
and probate of an instrument purporting to be the last will and testament of Mattheus Rauert, de-
ceased, that the Court thereupon fixed the 23d day of July, 1941, as the date for making proof of
said last will and testament, and due and legal notice of the filing of said petition and of the
time and place fixed for the hearing thereon was given by the Court, as provided by law, and on
said date, July 23, 1941, said instrument was duly proven, allowed, and admitted to probate in
this Court as and for the last will and testament of Mattheus Rauert, deceased, and letters tes-
tamentary were duly issued thereon to Richard Rauert, executor, as named in said last will and
testament, and he -thereupon qualified as such.
The Court finds that due and legal notice has been given to all persons of the time and place
fixed by the Court for the filing of claims against said estate, that said time has fully expired,
and all claims paid.
IT IS, THEREFORE, ORDERED AND ADJUDGED BY THE COURT that the time for filing claims against
said estate has fully expired, and that all persons, if any such there be, hiving claims against
said estate, and not filed herein, are forever barred and excluded from setting up said claims
against said estate.
