<br />WILL AND DECREE RECORD

<br />. LAST WILL AND TESTAMENT
<br />I, Mary Franz, of St.Paul, Howard County, State of Nebraska, being over the age of twenty -one
<br />years, -to -wit: of the age of sixty -five years, end of sound mind, do hereby make and declare this
<br />to be my last will and testament.
<br />I.
<br />I hereby revoke any and all wills and testamentary dispositions by me at any time heretofore
<br />made.
<br />II.
<br />I direct that all my just debts, expenses of my last illness, funeral charges and expenses of
<br />administration be first paid out of my estate by my executor hereinafter named as soon as may be
<br />found by him convenient.
<br />III.
<br />I give and bequeath to the Roman Catholic Church at St.Paul, Howard County, State of Nebraska,
<br />the sum - - - - - - - - - - - - - - with the request that they please remember me in their prayers.
<br />IV.
<br />I give and bequeath to the Old Ladies Home in Kearney, Nebraska, Lots six and seven in Block
<br />eight, Sheridan Place, Grand Island,Nebraska.
<br />V.
<br />All the rest, residue and remainder of my estate, both real and personal, whatsoever and
<br />wheresoever it may be, which I may own or have a right to dispose of at the time of my death, I
<br />give, devise and bequeath to my nieces, Hazel Franz Hughes and Caroline Burrows Herman, to my
<br />nephews, Fred Burrows, Arthur Burrows, George Burrows and Willard Franz, to my sister, Elizabeth
<br />Franz Burrows, and to my brother, John Franz, share and share alike.
<br />Should any of my nieces or nephews above mentioned die before me, then his or her share shall
<br />go to his or her issue by right of representation, and if the one so dying before me should have
<br />no issue, then his or her share shall fail and lapse. If either my brother or sister above named
<br />should die before me, then his or her share shall go to his or her heirs.
<br />VI.
<br />I constitute and appoint my nephew, Fred Burrows, executor of this will, and require that no
<br />bond or bonds be required of him as such by any court or judge.
<br />VII.
<br />I do hereby fully authorize and empower my executor above named to sell and dispose of any
<br />property, real or personal, that I may have at the time of my death and to make good and valid
<br />instruments of transfer thereof or any part thereof or any rights therein.
<br />VIII.
<br />If ay legatee or devisee shall directly or indirectly contest or dispute the probate of this
<br />will or maintain before any judicial body that this is not my last will or call in question before
<br />any tribunal the provisions of any legacy, devise or provision herein, then I absolutely revoke
<br />the legacy, devise or provision to said person and declare the same void and of no effect.
<br />In Testimony Whereof, I hereunto subscribe my name at Salt Lake City, Salt Lake County, State
<br />of Utah, this fourteenth day of November, A.D. , 1931.
