<br />Elizabeth MacDonald, Deceased. )
<br />Now on this 24th day of November, 1941, this cause came on for hearing upon the Final Report of
<br />Harold A.Prince, Executor under the last Will and Testament of Elizabeth MacDonald, deceased, which
<br />Final Report has been approved by Agathe Hanford and Ruth Hanford, and the court, after having
<br />examined the records and files in this case, finds that the time fixed by the court for filing
<br />objections to said Final Report has elapsed, and that no objections have been filed.
<br />And after having examined the records and files in this case and receipts on file, the court
<br />finds that all claims allowed have been paid in full; that the court costs, expenses of administra-
<br />tion, attorney fees, expenses of last illness and legacies specified in the last Will and Testament
<br />have been paid in full. The court further finds that an order has been entered in this estate bar-
<br />ring claims.
<br />The Court further finds that the Executor has accounted for all assets t'lat have come into his
<br />hands as Executor, and that there remains in his hands the sum of $1736.37 for distribution.
<br />The Court further finds that said estate was not subject to inheritance tax, either Federal or
<br />State.
<br />The Court further finds that under the last Will and Testament of the said Elizabeth MacDonald,
<br />deceased, the Executor has power to pay so much of the principal of the estate to Agathe Hanford,
<br />as in his judgment is most advisable; that said executor has filed a request for authority of this
<br />curt to pay the balance of X1736.37 to Agathe Hanford, the life tenant, and Ruth Hanford, the
<br />remainder man, that the said Agathe Hanford and Ruth Hanford requests the court to enter such an
<br />order.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that said Final Report of said Harold
<br />A.Prince, Executor, be and the same is hereby in all things ratified, approved and c6nfirmed.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that said Harold A.Prince do pay to
<br />Agathe Hanford and Ruth Hanford the balance remaining of $1736.37, and upon payment of same, to be
<br />discharged as Executor and his bond as executor released.
<br />The Court further finds that the said Elizabeth MacDonald died at her home in Hall County,
<br />Nebraska, a citizen and resident of Hall County, Nebraska., on May 4, 1941; that she left an estate
<br />consisting of both real and personal property; that she left a last will and testament, which has
<br />been heretofore admitted to probate in this court; that she was at the time of her death a widow
<br />and left no husband her surviving; that her sole and only heirs at law were her.sster, Agathe
<br />Hanford, and Marguerite Bryson, now Marguerite Bryson McNabb.
<br />The court further finds that the said Elizabeth MacDonald sometimes spelled her name as
<br />Elizabeth McDonald, and sometimes as Elizabeth MacDonald, and that wherever used in this estate,
<br />or in the estate of James H.MacDonald, deceased, it refers to one and the same person.
<br />The Court further finds that Marguerite Bryson and Marguerite Bryson McNabb are one and the same
<br />person.
<br />The Court further finds that the said Elizabeth MacDonald was theowner at the time of her death
<br />an undivided one -half interest in the following described real estate, to -wit:
<br />The North half of the Northwest Quarter (NJ NW), and the North half (NJ) of the South half ()
<br />of the Northwest Quarter (NWJ) of Section Ten 10), Township Nine (9), North,Range Twelve (12),
<br />West of the 6th P.M., in Hall County, Nebraska.
<br />which was the home and homestead of the said Elizabeth MacDonald at the time of her death.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that said real estate do pass and
<br />descend in accordance with the last will and testament of the said Elizabeth MacDonald to Harold A.
<br />Prince, as trustee, Agathe Hanford and Ruth Hanford, in accordance with And subject to the condi-
