<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF JOHN H.BRICKNER
<br />OF HAY SPRINGS, SHERIDAN COUNTY,
<br />NEBRASKA.
<br />I, John H.Brickner, of the City of Hay Springs, Sheridan County, Nebraska, to hereby make, pub-
<br />lish, and declare this my last Will and Testament in words and figures following:
<br />FIRST;; I order and direct that my Executor hereinafter named, pay all my just debts and funeral
<br />expenses as soon after my decease as conveniently may be.
<br />SECOND, After the payment of such funeral expenses and debts, I give and bequeath to my
<br />daughter, Mabel Kubo the sum of Five Hundred ($500.00) Dollars.
<br />THIRD, I give, devise and bequeath all the rest and residue of my estate, real and personal
<br />whatsoever and wheresoever to my children, Harry Brickner, Mabel Kubo, Ralph H.Brickner and Ger-
<br />trude Closman, in equal shares, absolutely: provided always, that if any child of mine shall die
<br />before me, leaving issue surviving me, the share of such child shall not lapse, but shall go and
<br />devolve as part of his or her estate, in the same manner as if he or she had survived me and
<br />died immediately after me.
<br />LASTLY, I make, constitute and appoint my son Harry Brickner to be Executor of this my last
<br />Will and Testament, hereby revoking all former Wills by me made.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my seal, the 14th day of
<br />August in the year of our Lord, one thousand nine hundred thirty —five.

<br />We whose names are hereunto subscribed do hereby certify that John H.Brickner, the testator,
<br />subscribed his name to this instrument in our presence, and in the presence of each of us, and
<br />declared at the same time, in our presence and hearing, that this instrument was his last will
<br />and testament, and we, at his request, sign our names hereto in his presence as witnesses.

<br />SHERIDAN COUNTY ) Rushville, in said County, on the 26th day of May A.D. 1941, present
<br />Clarence E.Benachoter,County Judge. In the matter of the estate of John H. Brickner,deceased,
<br />I,Clarence E.Benschoter County Judge in and for said county, do hereby certify that on the 26th
<br />day of May A.D. 1941, the instrument purporting to be the last will and testament of John H.
<br />Brickner deceased, was filed for probate in this Court. That on the 30th day of April A.D.
<br />1941, said instrument to which this is attached was duly proved, probated, and allowed, as the
<br />last will and testament of the said John H.Brickner,deceased, and the same was ordered to be
<br />recorded in the records of the Court aforesaid.

<br />1941, present Honorable Clarence E.Benschoter, County Judge.
<br />This day having been assigned by the order of this Court for hearing the petition of Harry
<br />Brickner, Executor of the Last Will and Testament of John H.Brickner, deceased, praying, among
<br />other things, for the allowance of his final account, heretofore filed in this Court on the
<br />14th day of October, 1941, and for a final settlement and discharge of his trust as such executor.
