That all of the statements and allegations set forth in <br />said petition are true; that the said Lillie Dearing Underwood died intestate at Santa Anna, <br />California on the twenty -first day of June 1936. That Lillie Dearing Underwood and Lilly Dearing <br />Underwood are one and the same person. <br />The court further finds that the said Lillie Dearing Underwood, at the time of her death, was <br />seized and possessed of an interest in real estate situated in Hall County, Nebraska, set forth <br />as follows: <br />An undivided one -sixth interest in Lot number two (2) in Block seventy_ -six (76) of the <br />original Town, now City, of Grand Island,Hall County, Nebraska. <br />The court further finds that no application has been made in the State of Nebraska for the <br />appointment of an administrator of the estate of said deceased, that the husband of the said Lillie <br />Dearing Underwood pre- deceased her, that she did not remarry after the death of said husband, and <br />that her only heir at law was her mother, Lydia Dearing of Grand Island,Nebraska; and the court <br />hereby finds and determines that the said Lydia Dearing was the sole and only heir at law of the <br />said Lillie Dearing Underwood, deceased, and that said interest in said real estate descended to <br />her by operation of law. <br />It is therefore ordered adjudged and decreed by the court that the said Lydia Dearing,deceased, <br />at the time of the death of the said Lillie Dearing Underwood, was the sole and only heir at law <br />of the said Lillie Dearing Underwood, that the decree of kinship between the said Lillie Dearing <br />Underwood and Lydia Dearing was that of daughter and mother, that the said undivided one -sixth <br />interest in said above described real estate descended by operation of law to and became vested in <br />the said Lydia Dearing as a tenant in common, and that all claims and demands against the estate of <br />the said deceased whether due or to become due and whether absolute or contingent be and the same <br />hereby are forever barred. <br />Paul N.
