<br />IN THE COUNTY COURT OF BUTLER COUNTY, NEBRASKA.
<br />In the Matter of the Estate
<br />Of ) FINAL DECREE.
<br />Govie P.Disney, deceased. )
<br />Now on this 15th day of August, 1941, at 10 o'clock A.M., this matter came on to be heard upon
<br />the final account and petition for settlement of final account of Fred Hullihen as administrator
<br />of the estate of Govie P.Disney, deceased, also known as G.P.Disney, and upon the record, files
<br />and the evidence and the court being fully advised in the premises does find:
<br />That due and legal notice as required by law and order of the court to show cause, if any existed,
<br />why said final account should not be filed and approved has been duly published in the Butler
<br />County Press for the time required by the order of the court and that this court now has juris-
<br />diction of the subject matter, of the parties interested herein and to enter this decree.
<br />That Govie P.Disney, a resident and inhabitant of Butler County, Nebraska, died intestate
<br />therein on the 12th day of February, 1940, leaving as his sole and only heirs at law, Polly Disney,
<br />his widow, and William Disney and Joseph Disney, brothers, all over the age of 21 years. That
<br />said decedent left no issue him surviving and that he was predeceased by both his father and his
<br />mother.
<br />That Fred Hullihen was appointed administrator of said estate on the 29th day of March, 1940
<br />and thereafter qualified as such. That ever since said date said Fred Hullihen has been and now
<br />is acting as such administrator and as such administrator has fairly, fully and impartially
<br />performed the duties of his said trust and that his final report should be approved and confirmed
<br />in all respects.
<br />That said decedent died seized of the following described real estate, to -wit:
<br />The West 33 feet of Lot 9, Block 2, John Voitle's Addition to Grand Island,Nebraska.
<br />The South 90 feet of Lot 6, Block 5, Gilbert's Addition to Grand Island,Nebraska.
<br />Lots 6 and 7, Block 7 Litty's First Addition to David City, Nebraska.
<br />The East Half of the North East Quarter of Section 4, Township 14, North,Ra.nge 3 East of the
<br />6th P.M., in Butler County, Nebraska.
<br />The North West Quarter of Section 33, Township 8 North, Range 15 West of the 6th P.M., in
<br />Kearney County, Nebraska.
<br />The South Half of Section 22, Township 29 North,Range 15 West of the 6th P.M., in Holt
<br />County, Nebraska.
<br />That said real estate descends and should be assigned as follows:
<br />To Polly Disney a one -half interest absolutely and in fee simple and to William Disney and
<br />Joseph Disney each a one - fourth interest absolutely and in fee simple.
<br />That all of the personal property listed in the inventory filed in said matter has been
<br />reduced to cash or distributed among said heirs pursuant to an order of this court entered on
<br />September 3, 1940 and that there is no personal property on hand for distribution except cash
<br />In the sum of $2$88.40, as disclosed by the final report filed herein.
<br />That the court has entered an order barring all claims and that all claims filed - against
<br />said estate have been allowed and paid. That state inheritance tax and federal estate tax, ad-
<br />ministrator fee, attorney fee and court flosts have been paid.
<br />That said Govie P.Disney, deceased, also died seized of the following described real estate,
<br />to -wit:
