THIRD That on the 10th day of January, 1941, said Lawrence Anderson filed in this Court a petition for the probate of said Last Will and Testament and the appointment of himself as Executor thereof; and on the 10th day of January, 1941, an order of this Court was made therein assigning the 5th day of February, 1941, at 10 o'clock A.M. at the County Court Room in said County as the time and place for hearing the said petition, and ordering that notice of the pendency of said petition and the hearing thereof, be given to all persons interested in said matter by publishing a copy of said order in the Grand Island Independent, a legal newspaper printed in said county, for three successive weeks prior to said. day of hearing, and it appears by proof on file t.-at notice of said order was given as ordered by this Court. FOURTH. The Court further finds that on the 4th day of February, 1941, an order was entered herein by the Court appointing B.J.Cunningham, an attorney of Grand Island,Nebra.ska, as guardian ad litem to represent Lorraine Schroeder, of Grand Isla.nd,Nebraska, a granddaughter of said deceased, and on the same day said guardian ad litem filed a motion requesting ten days in which to prepare and file objections to tie probate of said. Last Will and Testament; that on the 14th day of February, 1941, said guardian ad litem filed objections to the probate of said Will and after hearing the testimony of the attesting witnesses to said Last Will and Testament and sundry other witnesses on the 18th day of February, 1941, said Will and Testament was duly proved, approved and allowed as the Last Will and Testament of said James August Gustav Schroeder deceased, the objections of said guardian ad litem were overruled, and a decree of probate was made thereon and Lawrence Anderson, named therein was, upon his giving bona in the sum of $1,000.00, as ordered by this Court, appointed Executor thereof, which Last Will and Testament is in words and. figures as follows: LAST WILL AND TESTAMENT. I, James August Gustav Schroeder, of Grand Island,Nebraska, do hereby make this my Last Will qnd Testament, hereby revoking all former Wills by me made, in words as follows: I hereby nominate my son-in-law Lawrence Anderson Executor of this Will. I hereby direct my said Executor to pay all my just debts and expenses of my last illness and burial and the expenses of probating this Will. After the payment of the above, I hereby bequeath unto my children Wilhemine Johanna Wiese the sum of One Dollar ($1.00); to Emma Wilhelmine Potts the sum of Ten Dollars ($10.00); to Herbert August Schroeder the sum of Ten Dollars ($10.00); to my granddaughter Elsie, who is the daughter of my deceased daughter Anna. Helene, the sum of Ten Dollars 010.00); to Arnold. Theodore Schroeder the sum of Ten Dollars ($10.00); to Elnora Irene Anderson all of my household goods and personal effects, including furniture and books; to my granddaughter Lorraine who is the daughter of my deceased son Hugo Albert Schroeder, the promissory note of her father dated June 1, 1928, in the principal sum of $1,000.00, payable to me, which her father gave to me for money borrowed from me, b.?t which note was never paid. After the payment of the above legacies, I hereby devise and bequeath the rest, residue and remainde_- of my estate to my three children, Walter Johann Schroeder, Ernest Friedrick Schroeder and Elenora Irene Anderson, share and share alike.
