In County Court. <br />County of Buffalo ) <br />In the matter of the estate of John J.Mosser,deceasedt I hereby certify that on the 24th day <br />of June, 1938, the foregoing instrument of writing to which this certificate is attached was duly <br />probated and allowed as the Last Will and Testament of John J.Mosser deceased and the same was <br />duly filed and entered upon the probate records of said county. <br />Witness my hand and official seal, this 24th day of June, 1938. <br />Harvey M.Wilson, <br />(SEAL) County Judge. <br />IN THE COUNTY COURT OF BUFFALO COUNTY, NEBRASKA. <br />In the Matter of the Estate ) <br />Of ) FINAL DECREE. <br />John J.Mosser, deceased. ) <br />Now on this 17th day of July, 1941, this cause came on for hearing, said hearing having been <br />continued from May 7, 1940, upon the final report of Sidney J.Mosser, Executor of the Last will <br />and testament of John J.Mosser, deceased, and upon his petition for settlement of said account and <br />his discharge herein, and the Court having examined said report and the records and files in said <br />estate, and being duly advised in the premises, finds that due and legal notice has been given to <br />all persons interested in said estate of the time and place fixed for hearing upon said final report, <br />as heretofore ordered by the Court, and there being no objections on file to said final report, <br />the court examined the same together with the vouchers on file and the testimony in support thereof, <br />and being duly advised in the premises, the Court finds that said report is true and correct in all <br />things and ought to be approved and allowed as and for the final report of said Executor. <br />The Court finds that John J.Mosser died on the 15th day of February, 1938, and at the time of <br />his death was a resident and inhabitant of the County of Buffalo, and State of Nebraska. <br />The Court further finds that on the 21st day of February, 1938, Sidney J.Mosser filed his duly <br />verified petition praying for the allowance and probate of an instrument purporting to be the last <br />will and testament of John J.Mosser,-- deceased. That the Court thereupon fixed the 21st day of <br />March, 1938, as the date for making proof of said last will and testament, and due notice of the <br />filing of said petition and of the time and place fixed for the hearing thereon was given by the <br />Court in the manner provided by law. That objections were filed to the probate of said last will <br />and testament; that hearing was continued to the 24th day of June 1938, on which date said last <br />will and testament was admitted to probate and allowed as the last will and testament of John J.Mosser <br />deceased. That Letters Testamentary were issued to Sidney J.Mosser, as named in said last will and <br />testament, and he thereupon qualified as such Executor. That the contestants appealed to the Dis- <br />trict Court of Buffalo County, Nebraska, and upon trial had on the 19th day of January, 1940, the <br />District Court of Buffalo County; Nebraska, ordered, adjudged and decreed that the document offered <br />for probate as the last will and testament of John J.Mosser, deceased, is the last will and testament <br />of said John J.Mosser, testator, and that said will should be and hereby is admitted to probate. <br />That no appeal was had from the judgment of the District Court of Buffalo County, Nebraska. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for the filing of claims against said estate; that all claims filed, and <br />the expense of administration, including court costs, Executor's fees, and attorneys fees, have <br />been paid. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the time for filing claims has <br />fully expired, and that all persons having claims against said estate, if any such there be, and not <br />filed herein, are forever barred and excluded from setting up or asserting any such claims against <br />said estate. <br />
