<br />arising from my entire estate, and that my wife Julia Anne Mosser be continued in possession of our
<br />home at Sheltcn, Nebraska, same to be kept as and for her homestead during her lifetime.
<br />(b) At the death of my wife Julia Anne Mosser to pay all her just debts and funeral expenses.
<br />(c) Upon the death of my wife Julia Anne Mosser to distribute and divide my residuary estate in
<br />manner and form following:
<br />1. To my son Phillip E.Mosser the sum of One Dollar.
<br />2. To my daughter Caroline Turney the sum of One Dollar.
<br />3. To my grandchildren Ray Mitchel, Elsie Mitchel Saylor, Mary Dubbs Evison, Evelyn Dubbs Smith,
<br />Neva Dubbs, Benton Dubbs, Luetta Dubbs, Vivian Dubbs, Vera Dubbs, Wanda Dubbs, Charlotte Dubbs,
<br />Charles Dubbs, the sum of One Dollar each; and to Roy Mitchel the sum of Two Hundred Dollars.
<br />. The remainder of my estate, share and share alike, to Mrs. Nellie Sherer, Mrs. Myra Powell,
<br />Mrs.Harriet Haws, Lela Mosser and Sidney J.Mosser. Because, however, of certain advances which
<br />I have made during my lifetime to each of the five last named children, it is my will that the
<br />advances of each be charged against their distributive share, it being my will that the notes of
<br />each of the last five named children which are in my possession shall bear interest as provided
<br />therein, which interest shall be payable to my Trustee to be used as income from my estate to be
<br />paid to my wife Julia Anne Mosser during her lifetime, then said notes to be cancelled and returned
<br />to their respective makers, the amount thereof being charged against the estate of each as follows:
<br />Mrs. Nellie Sherer shall. 'be charged with the advancement of Fifteen Hundred Dollars ($1500.00).
<br />Mrs. Myra Powell shall be charged with the advancement of Five Hundred Dollars ($500.00).
<br />Mrs. Harriet Haws shall be charged with the advancement of Six Hundred Dollars ($600.00).
<br />Lela Mosser shall be charged with the advancement of Nine Hundred Dollars ($900.00).
<br />Sidney J.Mosser shall be charged with the advancement of One Thousand Dollars ($1,000.00).
<br />My said Trustee Sidney J.Mosser shall have full and complete power to sell, convey and transfer
<br />any and all real estate or property of any other nature or kind in my estate, and all conveyances
<br />signed by him shall be deemed sufficient.
<br />SIXTH: Should any of my children, to wit: Mrs. Nellie Sherer, Mrs. Myra Powell, Mrs. Harriet Haws,
<br />Lela Mosser or Sidney J.Mosser, no survive the settlement of my estate, it is my will that their
<br />share pass to their living children, if any, and if they should die without issue, then their share
<br />to become and form a part of my residuary estate and be divided and distrubuted as provided under
<br />Paragraph Five of this my Last Will and Testament.
<br />SEVENTH: Should any of the beneficiaries under this my Last Wull and Testament, other than my
<br />said wife Julia Anne Mosser, object to the probate thereof or in any wise directly or indirectly
<br />contest or aid in contesting the same or any of th.e provisions thereof or the distribution of my
<br />estate,thereunder� then and in that event I annull any devise or bequest herein made to such benefi-
<br />ciary, and it is my will that such beneficiary shall be absolutely barred and cut off from any
<br />share in my estate and his distributive share shall become a part of my -residuary estate and be
<br />distributed as provided in Paragraph Five of this my Last Will and Testament.
<br />IN WITNESS WHEREOF I have hereunto subscribed my name and affixed my seal at Kearney, Buffalo
<br />County, Nebraska on this 27th day of December, 1932 in the presence of Joseph C.Tye and Dora
<br />Cornelius whom I have requested to become attesting witnesses hereto.

<br />The foregoing instrument was subscribed, sealed, published and declared by John J.Mosser as and
<br />for his Last Will and Testament in our presence and in the presence of each of us, and we at the
<br />same time, at his request in his presence and in the presence of each other, hereunto subscribe
<br />our names and residences as attesting witnesses this 27th day of December, 1932.
