<br />said decedent, would be a suitable and proper person to be appointed Administrator With 'Will
<br />Annexed, did, upon his giving bond in the sum of $2,000.00 as ordered by this Court, appoint said
<br />Berny Schimmer Administrator With Will Annexed thereof; the Court further finds that the deceased at
<br />the time of her death, was a widow and that she left the following heirs -at -law, towwit: August
<br />Schimmer, a son, Minnie Hartwig, a daughter, Henry Schimmer, a son, John Schimmer, a son, Otto
<br />Schimmer, a son, Berny Schimmer, a son; Mamie Rathman, Rudolph Beier, Harry Beier, Nancy Rathman,
<br />Otto Beier, Henry Elmer Beier and Donald Seier, children of a predeceased daughter Emma Beier; and
<br />Irene Hansen and Olga Anderson, formerly Olga Henne, Children of a predeceased daughter Adele Henne.
<br />FIFTH.
<br />That on the 30th day of October, 1940, an order of this Court was made allowing said Administra-
<br />tor With Will Annexed one year in which to settle said estate and allowing creditors three months
<br />in which to file their claims against said estate, from the 27th day of February, 1941, and further
<br />ordering that a notice of the same be published in the Grand Island Independent, a legal newspaper
<br />published and circulating in Hall County, Nebraska, for three successive weeks prior to the 27th day
<br />of February, 1941, which order was corrected by an order of this Court on November 9, ,1940, wherein
<br />this Court allowed creditors three months in which to file their claims against said estate from
<br />the 4th day of December, 1940, and that a hearing be had on all claims filed in said Court on the
<br />6th day of March, 1941, at 9 o'clock A.M. and further ordering that a notice of said order be pub-
<br />lished in the Grand Island Independent, a legal newspaper published and circulating in Hall County,
<br />Nebraska, for three successive weeks prior to said 4th day of December, 1940, and it appears by
<br />proof on file that notice of said order of November 8, 1940, was published as ordered by this Court.
<br />SIXTH.
<br />The Court further finds that on the 4th day of November, 1940, the said Berny Schimmer, as Ad-
<br />ministrator With Will Annexed, filed in Court his inventory of the property of said estate, and that
<br />according to said inventory, the deceased died seized and possessed of the following described
<br />property, to -wit:
<br />Lot Seven (7) in Block One Hundred Twenty -nine (129) of Koenig and Wiebe's Addition to the
<br />City of Grand Island, Nebraska, also
<br />promissory notes and personal property in the face amount of $3,906.68.
<br />SEVENTH.
<br />The Court further finds that according to the terms and provisions of said Last Will and Testa-
<br />ment and codicil thereto, said property descends as follows: All personal and household effects to
<br />Minnie Hartwig, daughter of said testatrix; gfter pay ment of debts, expenses of funeral, adminis-
<br />tering estate and probating said Will and codicil thereto and the payment of $100.00 to the City
<br />of Grand Island for perpetual upkeep of her cemetery lot, all of her personal estate as follows;
<br />August Schimmer, a son, 1/8; Henry Schimmer, a son, 1 18; John Schimmer, a son, 1/8; Otto Schimmer,
<br />a son 1/8; Berny Schimmer, a son, 1/8; Minnie Hartwig, a daughter, 1 /8; Mamie Rathman, a grand-
<br />daughter, 1/56; Rudolph Beier, a grandson, 1/56; Harry Beier, a grandson, 1/56; Nancy Rathman, a
<br />granddaughter, 1/56; Otto Beier, a grandson, 1/56; Henry Elmer Beier, a grandson, 1/56; Donald
<br />Beier, a grandson,1/56; Irene Henne Hansen, a granddaughter, 1/16, and Olga Henne Anderson, a
<br />granddaughter, 1/16; the real estate described in paragraph Sixth hereof descended unto August
<br />Schimmer, a son, to be sold by him and the proceeds distributed by him to August Schimmer, a son,
<br />rienry Schimmer, a son, John Schimmer, a son, Otto Schimmer, a son, Berny Schimmer, a son, and
<br />Minnie Hartwig, a daughter.
<br />EIGHTH
<br />The Court further finds that on the 21st day of December, 1940, said August Schimmer, with
<br />his wife Maud A.Schimmer, acknowledged full payment and satisfaction of all interest in this estate
<br />and the property thereof, in writing under oath, in consideration of settlement of the indebtedness
