<br />1T. ,IS THEREFORE CONSIDERED AND DECREED by the Court that the final account of the said Executor
<br />be and the same is hereby approved and confirmed, and all of the acts and doings of the said
<br />Executor, as sho wn by the reports and orders hereinbefore made, be and the same are approved
<br />and confirmed, and upon distribution as herein ordered trie said Executor be discharged from his
<br />trust.
<br />That the real estate aforesaid be and the same is hereby assigned and distributed as follows,
<br />.subject, however, to all of the terms and provisions of said last will and testament:
<br />Dessie P.McGrath, so long as she remains the widow of Benjamin R.McGrath and unmarried;
<br />William M.McGrath, an undivided one- fifth, subject to said estate of said widow;
<br />Esther L.Flanigan, an undivided one- fifth, subject to said estate of said widow;
<br />Benjamin R.McGrath,, an undivided one - fifth, subject to said estate of said widow;
<br />James R.McGrath, an undivided one - fifth, subject to said estate of said widow;
<br />Harvey C.McGrath, an undivided one -fifth subject to said estate of said widow,
<br />IT IS FURTHER ORDERED AND DECREED that the said Executor pay the amount of cash on hand as
<br />aforesaid to the said William M.McGrath, as trustee, under the terms and conditions of said last
<br />will and testament, and deliver to the said William M.McGrath the undivided interest in said
<br />accounts and bills receivable as such Trustee.

<br />The Last Will of
<br />Christine Schimmer.
<br />I, Christine Schimmer of Grand Island,Nebr. do make this my last will, hereby revoking all former
<br />wills.
<br />I, appoint my son August Schimmer executor of this will and provide that he need give no bond.
<br />All my household goods, beds, bedding, clothes and furniture I give to my daughter Minnie Hart-
<br />wig, but if she precede me in death then I give said personalty to my children August, Henry,John,
<br />Otto and Berny in equal parts.
<br />My just debts, expenses of funeral, administering my estate and probating this will shall be
<br />paid out of my personal estate before distribution, but if that be insufficient then my real estate
<br />shall be sold to pay same.
<br />All my monies, bank deposits, notes, mortgages and other choses in action shall be divided into
<br />eight equal parts and shall go to my sons August, Henry, John, Otto, and Berny Schimmer and my
<br />daughter Minnie Hartwig, and to the children of my daughter Emma, deceased, towit Mamie,Rudolph ,
<br />Harry, Nancy, Otto and Henry Elmer Seier and Donald Seier and to the children of my deceased
<br />daughter Adelie Henne, towit Irene and Olga Henne.
<br />My real estate, Lot Seven (7) in Block One Hundred twenty nine (129) in Koenig & Wiebe's
<br />Addition to Grand Island, I give to my son August Schimmer. He shall sell said real estate under
<br />
