<br />that all of the residue belonging to this estate, both real and personal, is hereby assigned to
<br />hereunto set
<br />Elva M.Heuermann, widow of the testator, for her use and benefit and enjorment during the period
<br />on her natural life including real estate, personal and mixed property and upon her death the
<br />June, 1941.
<br />residue and remainder thereof in fee simple title and without any conditions whatsoever, except
<br />any indebtedness owned to the deceased by any of said beneficiaries or remainder men are hereby
<br />charged against them and to be paid, out of their respective shares, as provided by said last will
<br />and testament, Mary L.Heuermann, daughter or Grand Isla.nd,Nebraska, Bernard B.Heuermann, son, or
<br />June, 1941,
<br />Hamilton County, Nebraska, and William W.Heuermann, son, of Lancaster County, Nebraska, as tenants
<br />in common share and share alike and in absolute fee simple title without any limitations and subject
<br />to the further provision of the will of the testator that if any of his said children should depart
<br />this life in his lifetime, or in the lifetime of said widow, leaving issue or descendants that the

<br />share of said daughter or of either of said sons should not lapse or be forfeited but shall vest
<br />in and be distributed to such descendants in equal parts and proportions and by right of represen-
<br />tation, treat said executor is hereby directed to make, transfer, assign and set over unto said
<br />widow, Elva M.Heuermann, the shares of stock and the notes of Bernard B.Heuermann, menioned in the
<br />Inventory and appaisement herein without recourse and also all funds, monies and other items of
<br />personal property, such as household goods, community property, grain, crops and rentals on hand,
<br />taking her receipt as the surviving widow and holder of the life estate for the same, and it fur-
<br />thering appearing unto the Court that said executor has done all of the things required of him by
<br />law and by the orders of this Court, it is adjudged and decreed that all proceedings in this matter
<br />be confirmed and that said Executor's final report and account be approved and allowed and that
<br />he be discharged; that he be specially retained to close up miscellaneous items of business per-
<br />taining to thi., estate, which estate is now generally closed except for such special purposes, and
<br />that said Executor remain in office and his bond be not cancelled until he has completed all of the
<br />items of business and filed with this court receipts of all persons, entitled to share therein.
