<br />WILL'AND DECREE
<br />SHORT WILL
<br />IN THE NAME OF GOD, AMEN
<br />I, Frederick W.Heuermann of Grand Island in the County of Hall, State of Nebraska, being of sound
<br />mind and memory and considering the uncertainty of this frail and transitory life, do therefore
<br />make, ordain, publish and declare this to be my last WILL AND TESTAMENT.
<br />FIRST, I order and direct that my Executor hereinafter named, pay all my just debts and funeral
<br />expenses as soon after my decease as conveniently may be.
<br />SECOND, After the payment of such funeral expenses and debts, I give, devise, and bequeath to
<br />my beloved wife, Elva M.Heuermann, for her use, benefit, and enjoyment during the period of her
<br />natural life all of the estate of which I may die seized including real estate, personal and mixed
<br />property, the same to be an estate for life, and I further direct and devise and bequeath the re-
<br />mainder of my said estate, real, personal and mixed, which shall be left upon the death of my said
<br />beloved wife, to my following named beloved children, to -wit: Mary L.Heuermann, of Grand Island,
<br />Nebraska, Bernard B.Heuermann of Hamilton County, Nebraska, and William W.Heuermann of Lincoln, Ne-
<br />braska, the same to descend to t em share and share alike as tenants in common and in absolute
<br />fee simple title without any conditions or limitations whatsoever and I further direct that in the
<br />event any one or more of my children shall depart this life in my lifetime, or in the lifetime of my
<br />said beloved wife, if she survives me, then if any of my said children, so departing this life,
<br />leave issue or descendants that his or her share shall not lapse or be forfeited, but shall be
<br />vested and distributed to such descendants in equal parts and proportions and by right of represen-
<br />tation.
<br />THIRD, I hereby direct and provide, as a condition of this my last will and testament that if
<br />at the time of my death any of my children are indebted to me or have any unpaid notes or obligations
<br />due me but not fully accrued or payable, tha -t each and all of my children, so owing me, shall be
<br />required to pay and settle such obligations and indebtedness to my estate during the time of admin-
<br />istration, or in the event they are unable or unwilling to do so then I further direct that in such
<br />event the same shall be considered charges and advancements to be deducted and charged against each
<br />of said children so indebted at the time of final distribution of the remainder of my estate upon
<br />the death of my beloved wife and the termination of her life estate, to the end that each of my
<br />children shall be treated fairly, impartially and shall inherit from my estate in equal parts and
<br />proportions and shall also pay and discharge their obligations to me and my estate as a part of my
<br />plan to treat each and all of my children impartially and without any favoritism.
<br />LASTLY, I make, constitute and appoint my beloved son, William W.Heuermann to be Executor of
<br />this, my last Will and Testament, hereby revoking all former wills by me made.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my.seal the 2nd day of
<br />June, in the year of our Lord, one thousand nine hundred thirty -six.
