<br />OF EMILIE HEYDE, DECEASED. )
<br />NOW on this 23rd day of April, 1941, this cause came on for hearing upon the final report filed
<br />herein by Albert Von Der Heyde, Executor of the Estate of Emilie Heyde, deceased, together with
<br />his petition for the approval and allowance of said report, settlement of said estate and his dis-
<br />charge herein, and the Court having examined the records and files of said estate, including said
<br />final report and the vouchers attached thereto, and being fully advised in the premises, finds:
<br />That on the 9th day of November, 1940, Albert Von Der Heyde filed his petition in this Court
<br />alleging among other things that his wife, Emilie Heyde, departed this life on the 8th day of
<br />October, 1940, a resident of Hall County, Nebraska, at the time of her death, and leaving a Last
<br />Will and Testament which he offered for probate in this Court.
<br />And the matter coming on to be heard upon the evidence after due notice as provided by law,
<br />said instrument was duly and legally admitted to probate in said Court as and for the Last Will
<br />and Testament of the said Emilie Heyde, deceased, and the said Albert Von Der Heyde, named therein
<br />as executor, was issued Letters Testamentary on the 30th day of November, 1940, and proceeded
<br />immediately thereafter to administer the assets of said estate in accordance with the terms and
<br />provisions of said Will.
<br />That notice was given to all creditors as provided by law, and all persons having claims
<br />against said estate not filed and allowed within the time provided by order of this Court, if
<br />any such there be, should be forever barred and excluded from setting up or asserting any such
<br />claims against said estate.
<br />That said decedent departed this life leaving as her heirs -at -law and only heirs -at -law, her
<br />surviving husband, Albert Von Der Heyde, and their eight children, namely:
<br />Anna L. Calkins, a daughter, of Washington, D.C. ,
<br />George A.Heyde, a son, of Grand Island,Nebraska,
<br />Minnie J.Springer, a daughter, of St. Joseph, Missouri,
<br />Ella A.Martin, a daughter, of Grand Island, Nebraska
<br />Albert F.Heyde, Jr., a son, of Scotts Bluff, Nebraska,
<br />Louis W.heyde, a son, of Omaha, Nebraska,
<br />Alice H.Husbands, a daughter, of Ord,Nebraska, and
<br />Herbert Heyde, a son, of Oakland,California.
<br />That said decedent at the time of her death was the owner of an estate consisting of both
<br />real and personal property situated in Hall County, Nebraska, said presonal property being
<br />cash invested in United States Postal Savings and the Equitable Building and Loan Association
<br />of Grand Island,Nebraska, and said real estate being described as follows:
<br />Commencing at a point thirty -three (33) feet east and Sixty(60) feet north of the southwest
<br />corner of Lot Number Nine (9) of the County Subdivision of the -West half of the Southwest
<br />Quarter of section Fifteen (15) in Township Number Eleven (11),North of Range Number Nine (9)
<br />West of the 6th P.M., in Hall County, Nebraska, as the same is duly recorded, said point
<br />being the Northwest corner of the tract described in the deed from Albert v.d.Heyde and Emilie
<br />Heyde, husband and wife grantors to Margaretha Lindeman which is recorded in Book 43 at page
<br />550 of the deed records of said County, running thence east 127 feet, along the north line
<br />of the Lindeman tract, thence north at right angles 60 feet, thence west at right angles 127
<br />feet and thence south at right angles 60 feet to the place of beginning the same being a rec-
<br />tangular piece of ground 60 by 12 0" on Locust Street, located in Grand Island, Hall
<br />County, Nebraska.
<br />That the Grand Island Independent in publishing the "Notice of Probate of Will" erred in the
<br />spelling of said decedent's name, in that they have published her name in one instance in said
<br />publication as Eimilie Heyde, when in fact her true name is Emilie Heyde, and so whereever in
<br />this proceedings the first name of said decedent is written or published as Eimilie Heyde, it
<br />refers.to_ one and the same person as Emilie Heyde, the decedent in this estate proceedings.
<br />That said estate of said decedent was not of sufficient value to be subject to the payment of
<br />any Inheritance Tax either by virtue of the laws of the State of Nebraska or the laws of the
<br />United States Government.
<br />That under the terms and conditions of the Last Will and Testament of the said Emilie Heyde,
