THE AUGU &TINE CO. 19800.12.88 <br />Now, on this 7th day of May, 1941, this cause came on for hearing upon the final report of <br />Lillian Dillon, Executrix under the last will and testament of said Thomas M.Dillon, deceased, and <br />upon her petition for a settlement of said estate and her discharge herein and the.Court, having <br />examined said report and the records and files in said estate, and being fully advised in the <br />premises, finds that due and legal notice has been given to all persons interested in said estate <br />of the time and place fixed for hearing upon said final report, as heretofore ordered by the Court, <br />and no one appearing to object to said final report, the Court examined the same, together with the <br />vouchers on file and the testimony in support thereof, and being duly advised in the premises, <br />finds that said report is true and correct in all things, and ought to be approved and allowed as <br />and for the final report of said Executrix. <br />The Court further finds that said Thomas M.Dillon <br />departed this life on the 21st day of August, <br />1940, and at the time of his death was a resident and <br />inhabitant of Hall County, Nebraska. <br />The Court further finds that a petition was duly <br />filed on the 26th day of August, 1940, by <br />Lillian Dillon, praying for the allowance and probate <br />of an instrument purporting to be the last <br />will and testament of Thomas M.Dillon,deceased, the Court <br />thereupon fixed the 18th day of September, <br />1940, as the date for making proof of said last will <br />and testament, and due notice of the filing <br />of said petition and of the time and place fixed for <br />the hearing thereon was given by the Court, <br />in the manner prescribed by law, and on said date said <br />instrument was duly proven, allowed, and <br />admitted to probate in this Court as and for the last <br />will and testament of said thomas M. Dillon, <br />deceased, letters testamentary were duly issued thereon <br />to Lillian Dillon, Executrix, as named in <br />said last will and testament, and she thereupon duly <br />qualified as such. <br />The Court further finds that said Thomas M.Dillon <br />left surviving him, as his sole and only <br />heirs at law, the following named persons: <br />Mabel Foy, a daughter, <br />Margarette Harris, a daughter, <br />Winnie Campbell, a daughter <br />Lillian Dillon, a daughter <br />Anna Cotton, a daughter <br />Conrad Dillon, a son, <br />Theodore Dillon, a son, <br />Harold Dillon, a son, all of legal age; <br />that said Thomas M.Dillon was a widower at the time of his death, that Ella Dillon, his wife, had <br />preceded the said Thomas M.Dillon in death. <br />The Court further finds that distribution of the personal property has been made as provided <br />by the terms of the last will and testament of said Thomas M.Dillon, deceased; that the receipts <br />of Mabel Foy, Margarette Harris, Winnie Campbell, Lillian Dillon, Anna Cotton, Conrad Dillon, <br />Theodore Dillon, and harold Dillon, have been filed herein, accepting such distribution in full <br />satisfaction of their interests in the personal property of said Thomas M.Dillon, deceased. <br />The Court further finds that due and legal notice has been given to all persons of the time <br />and place fixed by the Court for the filing of claims against said estate, that such time has <br />expi,r.ed, and that all claims allowed against said estate have been paid, and that all claims against <br />said estate not filed herein are forever barred and excluded; that all expenses of administration <br />have been paid; that the said estate was not subject to inheritance tax, either state or Federal. <br />The Court further finds that said Thomas M.Dillon, at the time of his death, was seized as the <br />owner in fee simple of the following described real estate, to -wit: <br />Lot Five (5) in Block Nineteen (19), in Fairview park Addition, and <br />Fractional Lot Four (4) in Block Nineteen (19) in Fairview Park Addition, and its complement, <br />part of Fractional Lot Three (3), in Block Twelve (12) in H.G.C1ark's Addition. <br />all in Grand Island,Hall County, state of Nebraska, and <br />Cemetery Lot No. 144, section "D ", Grand Island Cemetery, <br />and that, under the terms of the last will and testament of said Thomas M.Dillon, deceased, all <br />of said real estate was devised as follows: <br />
