<br />County,Nebraska,on the 29th day of December,1940,and his estate is now being administered in this
<br />Court as well as the estate of Charles Stoeger,deceased,and therefore John Stoeger,Nettie Wheeler,
<br />Lillian Ihde,Clarence Stoeger,Mary Engbert,and George Stoeger,is well as Anna Stoeger,surviving
<br />widow of Charles Stoeger,and their three ohildren,Deverne Stoeger,Cleo Stoeger and Glenn Stoeger,
<br />are the sole and only interested parties in this estate,and all have joined in the application
<br />filed in this Court on the 14th day of April 1941 praying for a modification of said Decree, de-
<br />creeing that two- twenty - firsts interest in and to the above described real estate descended by
<br />operation of the Statutes of Descent of the State of Nebraska to Charles Stoeger in stead of to
<br />his three children,Deverne Stoeger,Cleo Stoeger and Glenn Stoeger as originally entered in the
<br />Decree of this Court on the 10th day of February,1937.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the application of the heirs -at-
<br />law or Elizabeth Stoeger,sometimes known as Elyzabeth Stoeger,deceased,filed herein on the 14th
<br />day of April,1941,praying for a modification of the Decree entered in said estate on the 10th day
<br />of February,1937,wherein two- twenty- firsts interests of the above described real estate was decreed
<br />to Daverne Stoeger,Cleo Stoeger and Glenn Stoeger,children of Charles Stoeger,deceased,be and the
<br />same is hereby modified to read that said two - twenty - firsts interest in and to said real estate
<br />be decreed to Charles Stoeger,in that he was living at the time of the death of Elizabeth Stoeger,
<br />sometimes known as Elyzabeth Stoeger,and therefore,inherited an undivided two - twenty - firsts inter =3
<br />eat in and to her real estate by operation of the Statutes of Descent of the State of Nebraska.

<br />Now on this 19th day of April,1941,this cause came on for hearing before the court upon the
<br />petition of Anna Stoeger for determination of heirship in the matter of the estate of Charles
<br />Stoeger,deceased. Thereupon evidence was duly introduced and the said cause submitted to the
<br />court.The court finds from the evidence adduced and fvom the filed. and records in said cause
<br />that due notice of the time and place fixed for the hearing on said petition has been given by
<br />publication according to the order of the court heretofore made and entered;finds that the said
<br />Charles Stoeger died intestate on the 19th day of June,1933,being a resident and inhabitant of
<br />Goshen County,Wyoming,and being seized of an undivided two twenty - firsts (2/21) interest in the
