<br />The Court further finds that the Guardian of the two minor children has receipted for said
<br />Fagot mortgage and for the shares of stock in the Nebraska Consolidated Mills Company, and that
<br />the said George A.Heyde has receipted for the remaining personal property; that there are no
<br />assets remaining to be administered upon and that this estate should be closed.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that said estate be and the same
<br />is hereby closed, the said George A.Heyde as Administrator is hereby discharged and his bond re-
<br />leased.

<br />NOW on this 14th day of April,1941,this cause came on further to be heard upon the applicat-
<br />ion signed by all of the heirs -at -law of Elizabeth Stoeger,sometimes known as Elyzabeth Stoeger,
<br />Deeeased,praying for a modification of the Decree entered by this Court in said Estate on the
<br />10th day of February,1937,wherein the Court decreed that the real estate,described as the South-
<br />west Quarter (SW;}) of Section Thirty (30) in Township Twelve (12) North,Range Twelve (12) West of
<br />of the Sixth P.M.,Hall County,Nebraska,owned by the deceased at the time of her death,descended
<br />by operation of the Statutes of Descent of the State of Nebraska to Philip Stoeger,surviving
<br />husband,John Stoeger,a son,Nettle Wheeler,a daughter,Lillian Ihde,a daughter,Clarence Stoeger,a
<br />son,Mary Engbert,a daughter,and George Stoeger,a son,and Deverne Stoeger,Cleo Stoeger and Glenn
<br />Stoeger,children of Charles Stoeger,a deceased son of the said Elizabeth Stoeger,sometimes known
<br />as Elyzabeth Stoeger,and the Court having examined the records and files of said etate,together
<br />with the Decree entered therein,finds that the Court erred in decreeing a share of said real estate
<br />to Deverne Stoeger,Cleo Stoeger and Glenn Stoeger, in that their father,Charles Stoeger,died on
<br />the 19th day of June,1933,aubsequent to the death of their grandmother,Elizabeth Stoeger,some-
<br />times known as Elyzabeth Stoeger,who preceded her son in death on the 17th day of Apri1,1926,and

<br />therefore, their father,the /Charles Stoeger,inherited a vested interest in and to said real estate
<br />from his mother,the said Elizabeth Stoeger,sometimes known as Elyzabeth Stoeger,and should-have
<br />been named as one of the heirs,taking the same proportionate share as was decreed to his brothers
<br />and sisters. 6
<br />The Court further finds that Philip Stoeger,surviving husband of Elizabeth.Stoeger,sometimes known
<br />as Elyzabeth Stoeger,deceased,is now deceased,he having departed this life a resident of Hall
