<br />FINAL DECREE
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />In the Matter
<br />of the ) FINAL DECREE.
<br />Estate of LYDIA HEYDE,
<br />Deceased.
<br />Now on this 5th day of February, 1941, this cause came on to be heard upon the Final Report of
<br />George A.Heyde, Administrator, and the Court, after having examined said Final Report and the
<br />records and files in this case, finds that said report is in all things true and correct; that the
<br />Administrator has therein accounted for all the assets of the deceased which have come into his
<br />knowledge or possession and has complied with the orders of this Court;
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that said Final Report be and the
<br />same is hereby approvedt
<br />The Court further finds that all claims filed in said estate have been paid in full; that the
<br />time fixed for filing claims has long since elapsed; that notice of the time fixed for filing
<br />claims has been published in the manner and form provided by law and that all claims not now on
<br />file should be barred;
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that all claims not now on file
<br />be and the same are hereby forever barred.
<br />The Court further finds that there is left in the hands of the Administrator certain personal
<br />property undisposed of, that George A.Heyde, Administrator, and husband of the said Lydia Heyde,
<br />deceased, has requested a distribution of said property in kind, whereby all the personal property
<br />remaining undistributed of any substantial value will be delivered to the guardian of the two
<br />minor children,Marilyn Heyde and Georgia Heyde.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the Administrator do transfer
<br />to the guardian the Fagot mortgage and the shares of stock owned by the deceased in the Nebraska
<br />Consolidated Mills Company, and that he transfer to himself the remaining personal property.
<br />The Court further finds that the said Lydia Heyde died on November 14, 1938; that she was
<br />immediately preceding her death a resident of Hall County, Nebraska; that she left her surviving
<br />as her sole and only heirs at law, George A.Heyde, her husband, and Marilyn Heyde and Georgia Heyde,
<br />daughters, both minors; that there are no other heirs.
<br />The Court further finds that the said Lydia Heyde was at the time of her death the owner of
<br />the following described real estate;
<br />Lot Six (6) in Block Twelve (12) in Baker's Addition to the City of Grand Island,Hall
<br />County, Nebraska;
<br />Lot Three (3) in Block One Hundred Twenty -seven (127), in Koenig & Wiebe's Addition to the
<br />City of Grand Island,Hall County, Nebraska; and
<br />Lot Four (4) in Block Thirty -six (36), in Wasmer's Addition to the City of Grand Isla d,
<br />Hall County, Nebraska.
<br />That Lot Three (3) in Block One Hundred Twenty -seven (127), Koenig & Wiebe's Addition to he
<br />City of Grand Island,Hall County, Nebraska, was the home and homestead of the said Lydia H yde,
<br />her husband and family.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that said Lot Three (3) in Block
<br />One Hundred Twenty -seven (127), Koenig & Wiebe's Addition to the City of Grand Island,Hall County,
<br />Nebraska, was the home and homestead of the 'said Lydia Heyde and family, and the same is hereby
<br />s6t off unto the said George A.Heyde for life.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the remaining real estate, in-
<br />eluding the remainder after said life estate in said above described real estate,be and the same
<br />is hereby set off to George A.Heyde, Marilyn Heyde and Georgia Heyde, as tenants in common, share
<br />and share alike.
