<br />ment, by the terms of said agreement the said Mary A.Lesher was entitled to receive the sum of
<br />Five Thousand Dollars ($5,000.00), and the home occupied by James B.Lesher and Mary A.Lesher at
<br />the time of the death of James B.Lesher.
<br />The Court further finds that under the terms of the Will of the said James B.Lesher, deceased,
<br />there was a provision,, that the said Mary A.Lesher should receive the sum of $5000.00 from said
<br />Estate; that a dispute arose as to whether the provision of the Will included the amount provided
<br />for under the ante- nuptial contract above referred to, and, that by reason thereof, objections were
<br />filed to the probate of the Will by Carl Lesher, one of the legatees.
<br />The Court further finds that the -said Mary A.Lesher was represent6d in said contest by her
<br />Attorneys, Frank A.Johnson and Prince & Prince; that on or about the 20th day of July, 1940, the
<br />said Mary A.Lesher,widow, and the children of James B.Lesher,deceased,entered into an agreement
<br />and settlement of the matters in contest and dispute, by the terms of which agreement, the children
<br />of James B.Lesher, deceased, agreed to and did pay to the said Mary A.Lesher the sum of Sixty -one

<br />Hundred Twenty -one Dollars and Seventy -five Cents ($6121.75) in cash and that they conveyed to
<br />the said Mary A.Lesher Lots Thirteen (13) and Fifteen (15) in Block Ten (10) in College Addition
<br />to West Lawn in the city of Grand Island,in Hall County, Nebraska, and that the said Mary A.Lesher
<br />agreed to and did accept said sum in full and complete settlement of all of her claims against the
<br />Estate of James B.Lesher, deceased, under the ante- nuptial agreement heretofore referred to and
<br />under the terms of the Last Will and Testament of James B.Lesher,deceased; that a copy of said
<br />agreement duly acknowledged by the said widow and children, was filed in this Court on the 20th.
<br />day of July, 1940; that an Order approving said settlement was entered by this Court and the Court
<br />after due consideration found it was a full, fair and complete settlement of all matters in dis-
<br />pute in connection with said Estate and in full settlement of all claims of the said Mary A.Lesher,
<br />as widow of James B.Lesher, deceased, under said anti - nuptial agreement and as legatee under said
<br />Will.
<br />The Court further finds that the said James B.Lesher was, at the time of his death, the owner
<br />of a fee simple title to the following described property to -wit:
<br />Lot Fourteen (14) in Block Four (4) in the Village of Polk, Polk County, Nebraska.
<br />The Northeast Quarter of the Southwest Quarter �NEJSWJ) and the Northwest Quarter of
<br />the Southeast Quarter (NWJSE4) of Section Five 5); and Lots Nine (9), Ten (10), Eleven (11)
<br />and Twelve (12) of the Cpwpt�y£�5ttb- division of the Northwest Quarter (NWT), and the West Half
<br />of the Northeast Quarter�of said Section Five, all in Township Ten (10) North,Range Ten (10),
<br />West of the 6th P.M. in Hall County, Nebraska, said tract consisting of eighty -eight and one -
<br />half (882) acres,more or less, according to the government survey.
<br />The Southeast Quarter (SE) of Section Thirty -six (36), in Township Twelve (12),North,Range
<br />Eleven (11), West of the th P.M. in Hall County, Nebraska.
<br />The South Half of the Northwest Quarter (S2NWJ), the West Half of the Southeast Quarter (W2SEJ)
