<br />LAST WILL AND TESTAMENT
<br />OF
<br />JAMES B.LESHER.
<br />I, James B.Lesher, of the city of Grand Island, in Hall County, Nebraska, being of sound mind
<br />and memory, but mindful of the uncertainty of life, do make, publish and declare this;. my last will
<br />and testament, hereby revolting all former wills and testaments made by me, that is to say:
<br />ITEM ONE.
<br />I give and bequeath to my beloved wife, Mary A.Lesher, should she survive me, the sum of Five
<br />Thousand ($5,000.00) Dollars, to be paid to her within one year, or as soon as conveniently may be,
<br />after my death. Should my wife die before me, this legacy shall lapse and become part of my resid-
<br />uary estate. My wife has her separate estate, amply sufficient to provide for her and a property
<br />settlement has been arranged between us.
<br />ITEM TWO.
<br />I give and devise to my daughter, Gertrude Lesher, of Grand Island, Nebraska, should she sur-
<br />vive me, Lot Fourteen (14), in Block Four (4), in the village of Polk, in Polk County, Nebraska, and
<br />all the land owned by me, comprising eighty -eight (88) acres, more or less, in Section Five (5), in
<br />Township.Ten (10), North,Range Ten (10),West of the 6 P.M. in Hall County, Nebraska, I direct that
<br />she shall not sell or mortgage said eighty -eight acre farm for five years after my death.
<br />ITEM THREE.
<br />I give and devise to my daughter, Rosa Starr, of Grand Island,Nebraska, should she survive me,
<br />the Southeast Quarter (SEJ) of Section Thirty -six (36), in Township Twelve,North, Range Eleven (11),
<br />West of the 6 P.M. in Mayfield Township, Hall County, Nebraska and the South seventy -three and a
<br />half (5.73.5) acres of the Southwest Quarter and West Half of Southeast Quarter (SWJ and WJ SEJ)
<br />in Section Thirty -one (31), in Township Twelve (12), North,Range Ten (10) West of the 6 P.M. in
<br />Prairie Creek Township, Hall County, Nebraska, said 73.5 acres being a rectangular tract with the

<br />south line of said Southwest Quarter and said said West Half of said Southeast Quarter as its
<br />south boundary, one -half the highway to be included in said 73.5 acres, the two tracts hereby
<br />devised comprising 233.5 acres, subject nevertheless to the restrictions contained in Item Five
<br />hereof. ITEM FOUR.
<br />I give and devise to my son, Carl Lesher, of Akron, Colorado, should he survive me, 233.5 acres
<br />in Section Thirty -one (31), in Township Twelve (12), North,Range Ten (10),West of the 6 P.M. in
<br />Prairie Creek Township,Hal1 County, Aebraska, described as follows: the South Half of Northwest
<br />Quarter (SJNWJ) and Southwest Quarter (SWJ) and West Half of Southeast Quarter (W *SEJ),excepting
<br />therefrom the rectangular tract of 73.5 acres devised by Item Three above to Rosa Starr, subject
<br />to the restrictions contained in Item Five.
<br />ITEM FIVE.
<br />I direct that neither of the devisees, Rosa Starr or Carl Lesher shall mortgage or sell and
<br />convey all or any part of said lands respectively devised to them by Items Three and Four hereof
<br />for ten years after my death, provided however, that as I desired to make an equal division of my
<br />lands in Mayfield and Prairie Creek Townships between my daughter, Rosa and my son, Carl, and to
<br />that end I devised to my daughter, Rosa, one quarter in Mayfield Township and said south 73.5 acres
<br />of my land in said Section Thirty -one to give each an equal acreage, now if some other divisions
<br />of the same would seem more convenient or desirable to them, they may make conveyances ur trades
<br />of said lands between themselves to effect a division that would be more suitable to each other,
<br />without waiting to make such redivision between themselves until the expiration of the ten year
<br />restriction against conveying their respective lands devised by Items three and four.
<br />ITEM SIX.
<br />All the rest, residue and remainder of my estate, both real and personal, now owned or here-
