<br />Katherine Dove, Elena Staal Helleberg, and Laura Staal Nielsen, praying for the allowance and
<br />probate of an instrument purporting to be the last will and testament of Jens Peter Staal, de-
<br />ceased, the Court thereupon fixed the 11th day of January, 1939, as the date for making proof of
<br />said last will and testament, and due notice of the filing of said petition and of the time and
<br />place fixed for the heating thereon was given by the Court in the manner prescribed by law, and on
<br />said date said instrument was duly proven, allowed, and admitted to probate in this Court as and
<br />for the last will and testament of said Jens Peter Staal, deceased, letters testamentary were
<br />duly issued thereon to Emil Rickert, Executor, as named in said last will and testament, and he
<br />thereupon duly qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time
<br />and place fixed by the Court for the filing of claims against said estate, that such time has
<br />expired, and that all claims allowed against said estate have been paid, and that all claims
<br />against said estate not filed herein are forever barred and excluded; that all expenses of admin-
<br />istration have been paid; that the said estate was not subject to inheritance tax, either state or
<br />Federal.
<br />The Court further finds that said Jens Peter Staal left surviving him, as his sole and only
<br />heirs at law, legatees and devisees, the following:
<br />Katherine Dove, a daughter,
<br />Elena Staal Helleberg (formerly Elena Staal),
<br />a daughter
<br />Laura Staal Nielsen (formerly Laura Staal),
<br />a daughter,
<br />Frances Rickert Phillips, a grand - daughter, and
<br />Peter Emil Rickert, a grandson (children of
<br />Anna Rickert, a deceased daughter of Jens Peter
<br />Staal, deceased),
<br />all of legal age.
<br />The Court further finds that distribution of the personal property has been made as provided
<br />by the terms of the last will and testament of said Jens Peter Staal, deceased; that the receipts
<br />of Katherine Dove, Elena Staal Helleberg, Laura Staal Nielsen, Frances Rickert Phillips, and Peter
<br />Emil Rickert, have been filed herein, accepting such distribution in full satisfaction of their
<br />Interests in the personal property of said Jens Peter Staal, deceased.
<br />The Court further finds that said Jens Peter Staal, at the time of his death, was seined as
<br />the owner in fee simple of the following described real estate, to -wit:
<br />The south half of the southwest quarter of Section Eight (S), in Township Eleven (11), North,
<br />Range Eight (S) West of the 6th P.M., in Merrick County, Nebraska, containing 90 acres,
<br />according to Government Survey,
<br />Lot Three (3), in Block `thirteen (13) in Russel Wheeler's Addition to the city of Grand
<br />Island,Hall County, state of Nebraska,
<br />The west half and the southeast quarter of Lot No. 192, in section "H" in Grand Island,
<br />Cemetery,
<br />and that, under the terms of the last will and testament of said Jens Peter Staal, deceased,
<br />all of said real estate was devised as follows:
<br />To Katherine Dove, an undivided one- fourth interest,
<br />To Elena Staal Helleberg, an undivided one- fourth interest,
<br />To Laura Staal Nielsen, an undivided one - fourth interest,
<br />To Frances Rickert Phillips, and Peter Emil Rickert, an undivided one- fourth interest,
<br />share & share alike, or an undivided 1 /8th each,
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the report of Emil Rickert,
<br />Executor, be, and the same is hereby, approved and allowed.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all claims against said estate,
<br />not filed herein, are forever barred.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the last will and testament
<br />of Jens Peter Staal, the absolute title to the following described real estate, to -wit:
<br />The south half of the southwest quarter of Section 8, in Township 11 North,Range 9 West
<br />of the 6th P.M., in Merrick County, Nebraska, containing 80 acres, according to Government
<br />Survey,
