<br />IN THE COUNTY COURT OF POLK COUNTY, NEBRASKA.
<br />IN THE MATTER OF THE ESTATE }

<br />AARON CARPENTER, DECEASED. )
<br />At a session of the County Court held in and for said County of Polk, the 14th day of March,1941.
<br />Present: L.M.Merrick, County Judge.
<br />BE IT REMEMBERED` That on the 18th day of February, 1941, Edward Carpenter, Administrator of the
<br />estate of Aaron Carpenter, deceased, filed in this Court his final account as such Administrator
<br />and a petition praying that said account be allowed; for a decree of heirship, an order of distri-
<br />bution, a final settlement thereon and discharge.
<br />For these purposes the 14th day of March, 1941, at 10 o'clock A.M. at the County Court Room in
<br />said county was assigned as the time and place for hearing said petition, examining and allowing
<br />said account; and it was ordered that notice of the pendency of said petition be given to all persons
<br />Interested in said estate by publishing a notice of said order in the Polk County Democrat, a legal
<br />weekly newspaper, printed and published in said County, three successive weeks prior to said day
<br />of hearing; and it appears by proof on file that said notice was given by Court.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST: That Aaron Carpenter departed this life on the 7th day of February, 1940, in Bonner County,
<br />State of Idaho, intestate, and at the time of his death he was a resident of Polk County, 1ebraska.
<br />SECOND: That on the 19th day of February, 1940, Edward Carpenter filed in this Court a petition
<br />praying for the appointment of Edward Carpenter as Administrator of the estate of said deceased;
<br />and on the 19th day of February, 1940, an order of this Court was made therein, assigning the 15th
<br />day of March, 1940, at 10 o'clock A.M., at the County Court Room in said County, as the time and
<br />place for hearing said petition, and ordering that notice be given to all persons interested in
<br />said matter by publishing a notice of said order in the Polk County Democrat, a legal weekly news-
<br />paper, printed and published in said County three successive weeks prior to said day of hearing,
<br />and it appears by proof on file that notice of said order was given as ordered by this Court.
<br />THIRD: The Court further finds that Edward Carpenter, named in said petition was, upon his
<br />giving bond in the sum of $10,000.00 as ordered by this Court, appointed Administrator as prayed;
<br />the Court further finds that the deceased at the time of his death was a widower and that he left
<br />the following heirs -at -law; Edward Carpenter, a son, and Belle Benda, a daughter.
<br />FOURTH: That on the 15th day of March, 19447 an order of this Court was made allowing creditors
<br />three months in which to file their claims against said estate and the administrator one year in
<br />which to settle said estate from the 12th day of April, 1940, and further ordering that a notice
<br />of the same be published in the Polk County Democrat, a legal weekly newspaper printed and published
<br />in said County three successive weeks prior to the lZth day of April, 1940, and it appears by proof
<br />on file that notice of said order was published as ordered by this Court.
<br />FIFTH: The Court further finds that on the 19th day of August, 1940, the said administrator
<br />filed in Court his inventory of the property of said estate, and that according to said inventory
<br />the deceased died seized and possessed of the following described property, to -wit:
<br />Lots Ten (10) and Eleven (11) in Block Eight (8) of Sharpe & Perkins Second Addition to the
<br />City of David City, Nebraska.
<br />Lots Eight (8), Nine (9) and Twelve (12) in Block Throe (3) Will Thorpe & Perkins second
<br />Addition to the City of David City, Nebraska.
<br />Lots Ten (10) and Twelve (12) in Block Seventeen (17) of College Addition to West Lawn in
<br />the City of Grand Island,Nebraska.
<br />Personal property in the value of about $10,000.00.
