<br />that said account be allowed; for a decree of heirship, an order of distribution, a final settle-
<br />said day of hearing; and it appears by proof on file that said notice was given as ordered by the
<br />Court and no objections thereto have been made or filed.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Albert Searson departed this life on the 23rd day of November, 1932, in Omaha, Douglas
<br />County, Nebraska, testate, and at the time of his death he was a resident of Hall County, Nebraska,
<br />and that said deceased left a Last Will and Testament which was filed in this Court for probate on
<br />the 8th day of December, 1932.
<br />SECOND.
<br />That Charles D.Searson was nominated in said Will as Executor thereof, and that the following
<br />are the legatees, devisees and heirs -at -law named therein: Charles D.Searson, a brother, Jennie
<br />I
<br />Searson, a daughter, Ruby Searson, a daughter, and Edna Searson, a daughter.
<br />THIRD
<br />That on the 8th day of December, 1932, said Charles D.Searson filed in this Court a petition
<br />for the probate of said Last Will and Testament and the appointment of Charles D.Searson as Executor
<br />thereof, and on the 8th day of December, 1932, an order of this Court was made therein, assigning
<br />the 3rd day of January, 1933, at 10 o'clock A.M. at the County Court Room in said County as the
<br />time and place for hearing said petition, and ordering that notice be given to all persons interested
<br />in said matter by publishing a copy of said order in the Grand Island Independent, a legal newspaper
<br />printed in said county for three successive weeks prior to said day of hearing, and it appears by
<br />proof on file that notice of said order was given as ordered by this Court.
<br />FOURTH.
<br />The Court further finds that on the 3rd day of January, 1933, said Last Will and Testament was
<br />duly proved, approved and allowed as the Last Will and Testament of Albert Searson, deceased, a
<br />decree of probate was made thereon, and Charles D.Searson named therein, was, upon his giving bond
<br />in the sum of $3,000.00, as ordered by this Court, appointed Executor thereof, which Last Will
<br />and Testament was in words and figures as follows:
<br />THE LAST WILL AND TESTAMENT OF ALBERT SEARSON
<br />I, Albert Searson of Grand Island,Hall County, Nebraska, which place I have made my home and
<br />which place is my home, make this my last will, hereby revoking all former wills by me made.
<br />I appoint my brother Charles D.Searson of Omaha, Nebraska, executor of this will.
<br />To my said brother,Charles D.Searson, I give, devise and bequeath all my estate, real, personal
<br />or mixed, that which I now own and which may be in.my possession as well as that to which I may be
<br />entitled at the time of my decease.
<br />He shall take all of said property and convert the same to money at his convenience, and shall
<br />hold, manage and invest all monies for me as to him may seem best under such terms and conditions
<br />as to him may seem proper without liability for any loss whatever.
<br />I give him One Thousand ($1,000.00) Dollars in full payment and compensation for all services
<br />to be rendered by him for and on behalf of my estate.
<br />After the payment of said legacy and all other necessary and proper expenses incident to the
<br />ment thereon and discharge.
<br />For these purposes the 5th day
<br />of March, 1941, at
<br />10 o'clock A.M. &t the County Court Room in
<br />said County, was assigned as the
<br />time and place for
<br />hearing said
<br />petition, examining and allowing
<br />said account; and it was ordered
