<br />ceased, and the compromise settlement with the charitable legatees mentioned in Paragraph Seventh
<br />of the last will and testament of Harry C.Faidley, deceased.
<br />The Court further finds that the said Lloyd H.Faidley has in writing dated December 10, 1940,
<br />agreed to the delivery of the property mentioned in Paragraphs Third and Fifth of said last will
<br />and testament, and to the waiver of the provisions of Paragraph Sixth of said last will and
<br />testament, and the payment of the sums provided for in said written agreement to the executor
<br />of the estate of Della Faidley, deceased, and has agreed to the payment of fifty per cent. of the
<br />principal sum of the legacies referred to in Paragraph Seventh, all in priority to the payment of
<br />his claim filed against said estate and hereinbefore mentioned.
<br />The Court further finds that in the event there are any undiscovered assets, or in the event
<br />any of the property, real or personal, should in the future become of any value, then the proceeds
<br />from such property, real or personal, shall be distributed and applied upon the unpaid balance of
<br />the claim of Lloyd H.Faidley, and in accordance with the terms of the last will and testament of
<br />Harry C.Faidley, deceased, and the written compromise settlement hereinbefore mentioned and dated
<br />December 10, 1940.
<br />The Court further finds that there are no further assets of any value in the hands of the
<br />Axecutors.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report and supple-
<br />ment thereto filed December 31, 1940, and February 10, 1941, be, and the same is hereby allowed
<br />and approved as and for the final report and said estate is hereby settled aid closed and said
<br />Executors discharged and their bonds as such are hereby released.
<br />That certain differences and disputes have arisen between first party and second party with
<br />reference to the property of the estate of said Harry C.Faidley, deceased; that among those
<br />differences are these:
<br />That said Lloyd H.Faidley has filed a claim against said Harry C.Faidley Estate in the amount
<br />of $22,600, with interest; that said claim was contested and is now Mending in the District
<br />Court of Hall County, Nebraska, on said contest.
<br />That the method of computing the interest on said claim and the amount thereof, should'.:it be
<br />Said Executors are hereby ordered to deliver to the Trustees any and all documents, papers, etc.,
<br />belonging to said estate and in their possession.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under and by virtue of the last
<br />will and teatament of Harry C.Faidley, deceased, absolute title to the following described real
<br />estate, to -wit:
<br />Lots Nine (9) and Ten (10) in Block Five (5) in Charles Wasmer's Addition to the city of
<br />Grand Island,Hall County, Nebraska,
<br />passed and descended to Della Faidley, devisee and legatee of said last will and testament; that
<br />the following described real estate, to -wit:
<br />An undivided one -half interest in the west two - thirds of Lot Two (2) in Block Eighty -five (85)
<br />in the city of Columbus, Platte County, Nebraska,
<br />The south half of the south half of Lot Seven (7) and the east half of the east half of
<br />Lot Eight (8) in Block Forty -one (41), Alamo Land and Sugar Company Subdivision Poreion 72,
<br />Hidalgo County, Texas,
<br />Lots Twenty -five (25) and Twenty -six (26), in Block Six (6), Lakeview Park Addition, Oklahoma
<br />City, Oklahoma,
<br />passed and descended to the Executors and Trustees, with full power of sale.

<br />last will and testament of Harry C.Faidley, deceased, hereinafter called Third Party, as follows:
