THE AUGUSTINE CO. 1960042.86 <br />and charges against said estate exceeded the credits and balances in any bank or banks at the date <br />of the death of Harry C.Faidley. <br />The Court finds that Paragraph Fifth was compromised and settled and Lloyd H.Faidley accepted <br />in full settlemeftt.o'f said paragraph 100 shares of the common stock of J. C.Penney Company, together <br />with $3810.00 accumulated dividends since the date of the death of Harry C.Faidley. <br />That the Executor of the estate of Della Faidley, deceased, has waived all claims to the <br />provisions of Paragraph Sixth in said last will and testament, and in lieu thereof and in lieu <br />of any and all other claims, against said estate,-except as hereinafter further mentioned, has <br />accepted, and there have been delivered to him, the said Hollis Showalter, Executor, 10 shares of <br />common capital stock of Grand Island Loan and Trust Company of the par value of $100.00 each, gross <br />value $1000.00, and the sum of $12,500 in cash - receipts therefor are filed herewith - the same <br />being in pursuance of said written agreement dated December 10, 1940. <br />The Court finds that after the payment of all expenses of administration, executors' fees, <br />attorneys' fees, court costs, and -all claims (except the claim of Lloyd H.Faidley) allowed herein, <br />there remained in the hands of the Executors, the sum of $29251.15, and which said sum, under and <br />by virtue of said written agreement, is to be applied upon the claim of Lloyd H.Faidley. <br />IT IS, THEREFORE, ORDERED BY THE COURT that the Executors pay the said sum of $29,251.15 to <br />Lloyd H.Faidley, being the balance on hand to be applied upon his said claim. <br />That said Harry C.Faidlpy at the time of his death was the owner of the following described <br />real estate: <br />Lots Nine (9) and Ten (10) in Block Five (5) in Charles Wasmer's Addition to the city of <br />Grand Island,Hall County, state of Nebraska; <br />that under and by virtue of the terms of Paragraph Third of his last will and testament, said <br />premises constituting the homestead and residence of said Harry C.Faidley at the time of his death, <br />has been set apart and delivered to Hollis Showalter, Executor of the estate of Della Faidley, <br />deceased. <br />That Harry C.Faidley �,!as also the owner at the time of his death of the following described <br />premises; <br />An undivided one -half interest in the west two - thirds of Lot Two (2) in Block Eighty -five (85) <br />In the city of Columbus, Platte County, state of Nebraska, and <br />The south half of the south half of Lot Seven (7) and the east half of the east half of Lot <br />Eight (8) all in Block Forty -one (41) Alamo Land and Sugar Company Subdivision, Porcion 72, <br />Hidalgo County, state of Texas (20 acres). <br />that said premises were sold by the Executors, under the authority and power vested in them in <br />Paragraph Eleventh of the last will and testament of Harry C.Faidley, deceasedg and with the <br />approval of the Court, for the sum of, to -wit: <br />The undivided one -half interest in the west 2 /3ds of Lot 2 in Block 85 in the city of Columbus <br />Platte County, Nebraska, for the sum of $15,000.00, and <br />The south half of the south half of Lot 7, and the east half of the east half df Lot 8, all <br />In Block 41 Alamo Land and Sugar Company Subdivision, Porcion 72, Hidalgo County, Texas, for <br />the sum of 42000.00, <br />and the proceeds, as shown by the final report and supplement thereto,have been accounted for <br />by the Executors. <br />That said Harry C.Faidley was also the owner of the following described real estate: <br />Lots Ttaenty -five (25) and Twenty -six (26) in Block Six (6), Lakeview Park Addition, <br />Oklahoma City, Oklahoma, <br />that there is no market for said lots, and the Court finds they have no market value. <br />The Court finds that all of the assets having any value have been sold, disposed of, and <br />delivered, as provided in said last will and testament and the written agreement dated December <br />10, 19401 by and between Lloyd H.Faidley individually, Hollis Showalter, as executor of the last <br />will and testament of Della Faidley, deceased, and The First National Bank of Grand Island, Ne- <br />braska, and Lloyd H.Faidley, as executors of the last will and testament of Harry C.Faidley,de <br />
