<br />ing said account;; and it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing such notice in the Grand Island Independent, a
<br />legal newspaper printed in said County, for three weeks prior to said day of hearing; and it appears
<br />by proof on file that said notice was given as ordered by Court and that no objections to said final
<br />account have been made or filed.
<br />Upon an examination of.the record and the evidence in this matter and being duly advised in
<br />the premises, the Court finds as follows:
<br />FIRST
<br />That Anna Scheer departed this life on the 18th day of February, 1935, in Hall County, Nebraska,
<br />intestate, and at the time of her death she was a resident of Hall County, Nebraska.
<br />SECOND.
<br />That on the 25th day of February, 1935, Julius P.Scheer, Otto Scheer, Frieda Schipman and Emil
<br />L.Scheer filed in this Court a petition praying for the appointment of Emil Scheer as Administrator
<br />of the Estate of said deceased; and on'the 25th day of April, 1935, an order of this Court was made
<br />therein, assigning the 20th day of March, 1935, at 10 o'clock A.M. at the County Court Room in said
<br />County, as the time and place for hearing said petition, and ordering that notice of the pendency
<br />of said petition and hearing thereof be given to all persons interested in said matter by publishing
<br />such notice in the Grand Island Independent, a legal newspaper printed in said County, for three suc-
<br />cessive weeks prior to said day of hearing, and it appears by proof on file that notice of said
<br />order was given as ordered by this Court.
<br />THIRD
<br />The Court further finds that Emil L.Scheer named in said petition, was upon his giving bond
<br />In the sum of $5,000.00, as ordered by this Court appointed Administrator as prayed; the Court
<br />further finds that the deceased at the time of her death was a widow and that she left the follow-
<br />ing heirs -at -law; Clara Huenbke,a daughter,Juliue P.Scheer, a son', Otto Scheer, a son, Frieda Sc$ p-
<br />man, a daughter, and Emil L.Scheer, a son, all over the age of 21 years.
<br />FOURTH
<br />That on the 20th day of March, 1935, an order allowing creditors three months from and after
<br />the 16th day of April, 1935, in which to file their claims against said estate and said Administra-
<br />tor one year in which to settle said estate, and further ordering that a notice to creditors be
<br />published in the Grand Island Independent, a legal Newspaper published and circulating in Hall County,
<br />Nebraska, for three successive weeks prior to said 16th day of April, 1935, and that a hearing on
<br />claims filed against said estate would be held at the office of the County Judge of Hall County,
<br />Nebraska, on July.16, 1935, at 9 o'clock A.M. and it appears by proof on file that notice of said
<br />order was published as ordered by this Court.
<br />FIFTH.
<br />The Court further finds that on the 22nd day of March, 1935, the said Emil L.Scheer, as
<br />Administrator, filed in Court his inventory of the property of said estate, and that according to
<br />said inventory, the deceased died seized and possessed of the following described property, to -wit:
<br />Westerly Fifty -two (52) feet Eight (8) inches of Lot Nine (9) in Block Thirteen (13) in Rollins'
<br />Addition to the City of Grand Island, Nebraska, with its complementary fraction in Arnold and
<br />Abbott's Addition, all in Hall County, lebraska.
<br />Lots Eight (8) and Nine (9) in Block Eighty -three (93) in Wheeler and Bennett's Fourth Addition
<br />to the City of Grand Island, in Hall County, Nebraska.
<br />North Half of the Northwest Quarter (N2NW4) of Section Two (2) in Township Twelve (12) North,Range
<br />Eight (8), West of the 6th P.M. in Merrick County-, Nebraska, and
<br />Notes, mortgages, participation bonds and cash of the approximate value of $41,656.92.
<br />SIXTH.
<br />The Court further finds that according to the laws of descent and distribution; said property
<br />descends as follows, to -wit: An undivided one -fifth (1/5) share to each of the following children
