<br />BE IT REMEMBERED, that on the 20th day of December, 1940, Adele H.Boehm, also known as Adel&
<br />H.Boehm, Executrix of the estate of Emma Damman, deceased, filed in this Court her final account
<br />as such Executrix and a petition praying that said account be allowed; for a decree of heirship
<br />an order of distribution, a final settlement thereon and discharge.
<br />For these purposes the 15th day of January, 1941, at 10 o'clock A.M. at the County Court Room
<br />in said County, was assigned as the time and place for hearing said petition, examining and allow-
<br />ing said account: and it was ordered that notice of the pendency of said petition be given to all
<br />persons interested in said estate by publishing a notice of said order in the Grand Island Inde-
<br />cendent, a legal newspaper printed and published in said county three successive weeks prior to
<br />said day of hearing; and it appears by proof on file that said notice was given as ordered by this
<br />Court and no objections have been filed or made thereto.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST.
<br />That Emma Damman, also sometimes known as Emma Dammann, departed this life on the 31st day of
<br />May, 1940, in Grand Island,Hall County, Nebraska, testate, and at the time of her death she was a
<br />resident of Hall County, Nebraska, and that said deceased left a Last Will and Testament which was
<br />filed in this Court for probate on the 8th day of June, 1940.
<br />SECOND,
<br />That Adele H.Boehm, also known as Adela H.Boehm, was nominated in said Last Will as Executrix
<br />thereof, and that the following are the legatees, devisees heirs -at -law named therein; John A.
<br />Noehrn, a son, Mrs.Marie A. Brooks, a daughter, Florence A. Schmidt, a daughter, Auguste C. Schmidt,
<br />a daughter, and Adele H.Boehm, sometimes known as Adela H.Boehm, a daughter, all of whom are over
<br />the age of 21 years.

<br />That on the 8th day of June, 1940, said Adele H.Boehm, also sometimes known as Adela H.Boehm,
<br />filed in this Court a petition for the probate of said Last Will and Testament and the appointment
<br />of said Adela H.Boehm, also sometimes known as Adele H.Boehm, as Executrix thereof; and on the 8th
<br />day of June, 1940, an order of this Court was made therein, assigning the 3rd day of July,1940,
<br />at 10 o'clock A.M. at the County Court Room in said County as the time and place for hearing said
<br />petition and ordering that notice be given to all persons interested in said matter by publishing
<br />a notice of said order in the Grand Island Independent, a legal newspaper printed and published in
<br />said County for three successive weeks prior to said day of hearing, and it appears by proof on
<br />file thpt notice of said order was given as ordered by this Court.
<br />FOURTH.
<br />The Court further finds that on the said third day of July,-194-0, said Last Will and Testament
<br />was duly proved, approved and allowed as the Last Will and Testament of Emma Damman,deceased, a
<br />decree of probate was made thereon and Adela H.Boehm, who is also sometimes known as Adele H.
<br />Boehm, named therein was, upon her giving bond in the sum of 010,000.00, as ordered by this Court,
<br />appointed Executrix thereof; the Court further finds that the deceased at the time of her death,
<br />was a
<br />widow, and that she
<br />left the
<br />following heirs -at -law
<br />to -wit: Adele H.Boehm,also
<br />sometimes
<br />known
<br />as Adela H.Boehm, a
<br />daughter,
<br />John A.Noehrn, a son,
<br />Marie A.Brooks, a daughter,
<br />Florence
<br />A.Schmidt, a daughter, Auguste C.Schmidt, a daughter, all over the age of 21 years, which Last
<br />Will and Testament and certificate of probate thereto attached is as follows:
<br />The Last Will of'Emma Dammann
<br />I, Emma Dammann of Merrick County, Nebraska, make this my last will, hereby revoking all former
<br />wills by me made.
<br />I appoint my daughter Adele H.Boehm executrix of this will without bond.
