<br />IN THE COUNTY COURT OF HO':1ARD COUNTY, NEBRASKA.

<br />FINAL ORDER.
<br />Herman Teng, Sr., Deceased. )
<br />Now on this 20th day of December, 1940, this cause came on for hearing upon the final account
<br />of Fred. E.Teng, administrator of the Estate of Herman Teng,Sr., deceased. The court finds that
<br />due notice of the hearing on said final account has been given by publication as is by law re-
<br />quired, as is shown by the proof of publication filed herein, and that the court has full juris-
<br />diction in the premises.
<br />And the court having examined said account, and the evidence, and being fully advised in the
<br />premises, finds:
<br />That the period required by law has been given to creditors of the said estate to file their
<br />claims for adjustment, and allowance, and by order of this court, due and legal notice of said
<br />period, of its limitations and the time and place thereby fixed'for hearing said claims, has been
<br />given as required by law, and that said period has expired; that all the claims that have been
<br />filed against said estate were either allowed or disallowed; that all claims allowed by the court
<br />have been paid and fully satisfied; that all expenses of last sickn -ss, funerpl and burial-of the
<br />deceased, and all costs and expenses of administration have been fully paid and satisfied; that
<br />there is no inheritance tax due or assessable against said estate, or against any of the heirs,
<br />devisees or legatees of said deceased, and that all claims against said estate are therefore forever
<br />barred.
<br />That said estate is therefore fully settled and ready for distribution, and said Final Account
<br />is true and correct and should be allowed as the final account of said administrator.
<br />The court further finds that at the time of the death of the said Herman Teng,Sr., the said
<br />Herman Teng held a real estate mortgage on Lot Five (5), in Block Five (5) in Evans' Addition to
<br />the City of Grand Island,Nebraska; that Charles Dodd and Ada Dodd, mortgagors, offered to convey
<br />said property to the heirs of Herman Teng,Sr., deceased, in consideration of being released of any
<br />and all liability arising out of said real estate mortgage; that after a full and complete delib-
<br />eration the said Fred E.Teng did on the 27th day of February, 1940, accept a warranty deed from
<br />the said Charles Dodd and Ada Dodd to the hereinbefore described real estate; that an agreement
<br />now since has been entered into by and between Fred E.Teng,Administrator and Emma Schmidt, one
<br />of the heirs of said Herman Teng,Sr., deceased, whereby the said Emma Schmidt agrees to accept a
<br />warranty deed to the hereinbefore described premises as full and final settlement with the said
<br />administrator as her share of the assets of said estate and said warranty deed shall represent
<br />full payment of the said Emma Schmidt's distributive share in the estate of Herman Teng,Sr. as
<br />provided for by the laws of the State of Nebraska; that the said Fred E.Teng did execute a war -
<br />ranty deed conveying the hereinbefore described property to the said Emma Schmidt on the 20th day
<br />of December, 1940.
<br />That the said Herman Teng,Sr., deceased, died seized of an estate of personal property con-
<br />sisting of household furniture, a real estate mort -age, certificates of deposit, and cash; that
<br />at the time of the death of the said Herman Teng,Sr., he was not seized of any real property.
<br />That the said Herman Teng died intestate a resident and inhabitant of Howard County, Nebraska
<br />on the 22nd day of January, 1940, leaving surviving him as his only heirs at law the following
<br />named children to wit, each of �wrhom has inherited an undivided one - eighth interest in and to all
<br />the property of the said deceased; Emma Schmidt, Martha Leschinsky, Katie Lamm, Ella Niemoth,
<br />Charles Teng, John Teng, Fred E.Teng, and Herman H.Teng, all of whom are of legal age.
<br />IT IS THEREFORE C ^NSIDERED, ORDERED, ADJUDGED AND DECREED:
<br />That the said final account be, and the same hereby is allowed as the final account of said
