<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF ALVIN C.ROBERTS.
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That I, Alvin C.Roberts, of Howard County, Nebraska, being of sound mind and disposinJ memory,
<br />but not unmindful of the uncertainties of human life, do hereby make, publish and declare this
<br />my last Will and Testament, hereby revoking all former wills by me made;
<br />1.
<br />I direct that my just debtd and funeral expenses be first paid out of my estate.
<br />11.
<br />The rest, residue and remainder of my estate of any and all nature whatsoever and wheresoever
<br />situated, of which I may die possessed,I hereby give, devise and bequeath unto my beloved wife,
<br />Ester Mary Roberts, to be hers absolutely.
<br />111.
<br />In the event my said beloved wife, Ester Mary Roberts,shall survive me, I hereby nominate,
<br />constitute and appoint her to be the Executrix of my,my last Will and Testament, and request
<br />that no bond be required of her.
<br />In the event my said beloved wife, Esther Mary Roberts, shall not survive me, or if, for any
<br />reason, she shall not qualify as Executrix or shall cease to serve as Executrix for any reason
<br />whatever, then I nominate, constitute and appoint my friend Vernon Rice of Grand Island,Nebraska,
<br />to be the Executor of this my last Will and Testament.
<br />My said Executrix or my Executor, Vernon Rice, shall have full power and authority to mortgage,
<br />or otherwise lien, any of the ,property of which I may die possessed, upon the approval of the
<br />County Judge of Howard County, Nebraska, without notice, for the purpose of paying any indebted-
<br />ness or other obligations of my estate, without the necessity of applying to the District Court
<br />of Howard County, Nebraska., for authority so to do.
<br />My said Executrix or my said Executor shall have full power and authority to extend any
<br />existing indebtedness upon the approval of the County Judge of Ho -ard County, Nebraska, without
<br />the necessity of applying to the District Court of Howard County, Nebraska,for authority so to do.
<br />IN WITNESS WHEREOF, I HAVE HEREUNTO, set my hand this 3rd day of April, 1940.
