<br />Now on this 11th day of December,1940,this cause came on for hearing upon the Final Report of
<br />August Herman Fuersteihau,Executor of the Estate of August Fuerstenau,Deceased,and upon the petition
<br />of said Executoe for the allowance and approval of said report,settlement of said estate and
<br />discharge herein,and the Court having examined the records and files herein and being fully advised
<br />in the premises finds that due and legal notice has been given to all persons of the time and place
<br />fixed by the Court for the hearing upon this report and the fbourt having examined said report,
<br />together with the vouchers on file,finds that said report is true and correct in all things and
<br />that the same ought to be approved and allowed as and for the Final Ifterort of the Executor,said
<br />estate settled and closed,and said Executor discharged.
<br />The Court further finds that the said August Fuerstenau departed this life on the 30th day of May,
<br />1940,and at the time of his death he was a resident and inhabitant of Hall County,N ebraska;that
<br />he left surviving him as his heirs at law and only heirs at law the following children,to -wit:
<br />Henry C.Fuerstenau,August Herman Fuerstenau,William Fuerstenau,and Frieda Sievers;that he left a
<br />Last Will and Testament which was by the consideration of this Court duly proven,allowed and admitt-
<br />edto probate on the 26th day of June,1940,and letters Testamentary were duly issued by this Court
<br />to the said August Herman Fuerstenau as Executor of the Estate of August Fuerstenau,Deceased:
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />that nothing further remains in the hands of said Executor belonging to said estate.
<br />The Court further finds that the estate of the deceased is not subject to an inheritance tax under
<br />the laws of the State of V ebraska nor to a Federal Estate tax under the laws of the United States.
<br />The Court further finds that the said August Fuerstenau died seized as the owner by fee simple
<br />title to the following real estate in Hall County Nebraska,to -wit:
<br />The North Half of the Northeast Quarter (N�,NE2) and the Southeast Quarter of the Northeast Quarter
<br />(SEJVE14) of Section Thirty -three (33),Township Twelve (12),Range Eleven (11),West of the 6th P.M.,
<br />Hall County,Nebraska.
<br />The Court further finds that under the terms and provisions of the Last Will and Testament of
<br />August Fuerstenau,deceased,all of said real estate hereinabove described passed and descended to
<br />Henry C.Fuerstenau,August Herman Fuerstenau,William Fuerstenau and Frieda Sievers,share and share
<br />alike, to have and to hold the same forever.
<br />IT IS,T11EREF0RE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the Final Report of said August
<br />Merman Fuerstenau,Executor of the Estate of August Fuerstenau,Deceased,be,and the same hereby is,
<br />In all things approved and allowed as and for the Final Report of said Executor and said estate
<br />settled and closed and said Executor discharged.
<br />IT IS FUR'xRER ORDERED,ADiUDGED AND DECREED BY THE COJTRT that all persons having claims against
<br />said estate,if any such there.be,are forever barred,enjoined and excluded from setting up or assert-
<br />ing any such claim against said estate.'
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that under the terms and provisions of the
<br />Last Will and Testament of the said August Fuerstenau,Deceased,all of the real estate hereinabove
<br />described passed and descended to Henry C.Fuerstenau,August Herman Fuerstenau,William Fuerstenau,
<br />and Frieda Sievers,ahare and share alike,to have and to hold the same forever.

<br />estate of said deceased and that the time
<br />so fixed had fully expired and that all persons having
<br />claims against the estate and not filed
<br />within the time limited by the Court are forever barred
<br />and excluded from setting up or asserting
<br />any such claims against said estate.
<br />The Court further finds that said Executor
<br />has paid the
<br />funeral expenses of said estate,all debts
<br />against said estate and the costs of these
<br />proceedings;that
<br />he has been authorized and directed
<br />to make a loan secured by a first mortgage
<br />on the real
<br />estate in said estate for this purpose and
<br />that nothing further remains in the hands of said Executor belonging to said estate.
<br />The Court further finds that the estate of the deceased is not subject to an inheritance tax under
<br />the laws of the State of V ebraska nor to a Federal Estate tax under the laws of the United States.
