590 WILL AND DECREE RECORI <br />THE AUGUSTINE CO. 13600.12.98 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />IN THE MATTER OF THE ESTATE <br />OF ) FINAL DECREE. <br />} <br />MARGARET M.GIESE ) <br />Now on this 11th day of December, 1940s this cause came on for hearing upon the Final Report <br />of George W.Giese,Sr. administrator of the.Estate of Margaret M.Giese, Deceased, and upon the <br />pdtition of said Administrator for the allowance and approval of said report, settlement of said <br />estate and his discharge herein, and the Court, being fully advised in the premises, finds that due <br />and legal notice has been given to all persons of the time and place fixed by the Court for the <br />hearing upon said Final Report and there being no objections to said report and the court having <br />examined the same together with the vouchers on file, finds that said report is true and that the <br />same ought to be approved and allowed as and for the Final Report of said Administrator, said estate <br />settled and closed and said Administrator discharged. <br />The Court further finds that the said Margaret M.Giese departed this life on the 16th day of <br />Zanuary 1940, and that at the time of her death she was a resident and inhabitant of Hall County, <br />Nebraska; that the said Margaret M.Giese died interstate; that a petition for letters of Adminis- <br />tration was filed on January 24, 1940 asking that said estate be admitted to probate and that <br />letters of administration be granted to the petitioner, George W.Giese, of Grand Island,Nebraska, <br />widower of the said Margaret M.Giese, upon the goods, real estate, chattels, rights and credits <br />of said Margaret M.Giese,deceased, and that upon a hearing held upon said petition after notice <br />was duly given to all persons interested in said estate said estate be admitted to probate on the <br />21st day of February, 1940, and letters of administration were duly issued by this court to the <br />said George W.Giese on the estate of Margaret M.Giese,Deceased. <br />The Court further finds that due and legal notice has been given to all persons of the time <br />and place fixed by the court for filing claims against the estate of the deceased and that the <br />time so fixed has fully expired and that all persons having claims against said estate and not <br />filed within the time limited by the court are forever barred and excluded from setting up or <br />asserting any such claim against said estate; the Court further finds that said Administrator has <br />paid the funeral expenses of said estate, all debts against said estate and the costs of these <br />proceedings, and that in order to do so it was necessary for him and the children, Mrs.Maybelle <br />Richards, Frederick J.Giese, George W.Giese,Jr. to advance the necessary funds, and that there <br />remains in the way of personal property subject to distribution One (1) Automobile,Hupmobile Five <br />Passenger Sedan 1937 Model, and the household furniture to pass and descend to George W.Giese Sr. <br />absolutely. <br />The Court further finds that the estate of said deceased is not subject to an inheritance tax <br />under the laws of the state of Nebraska nor to a federal estate tax under the laws of the United <br />States. <br />The Court further finds that the said Margaret $.Giese was <br />real estate at the time of her death, to -wit: <br />South 98 feet of lot 5 Block 136,Union Pacific Railroad Coi <br />that she left surviving her at the time of her death the said <br />Mrs. Maybelle Richards, Frederick J.Giese,George W.Giese,Jr. <br />age. <br />possessed of the following described <br />npany's Second Edition. <br />George W.Giese Sr. her widower; and <br />That all of the children are of legal <br />The Court further finds that the aforesaid real estate is the homestead of the said George W. <br />Giese and that subject to his homestead rights therein said estate passed and descended upon the <br />death of Margaret M.Giese to George W.Giese Sr., one -third undivided interest; and to Mrs. Maybelle <br />Richards, Frederick J.Giese and George W.Giese Jr., children of Margaret M. and George W.Giese,each <br />
