Kirk <br />(SEAL) County Judge <br />Filed for record this 30th day of November, 1940, at 10 :00 o'clock A.M. <br />Register of eeds <br />0- 0- 0- 0- c- c- o- c- c- o- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0-^- :--)- c- o- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- c- 0- 0- 0_0 -0 -0- <br />LAST WILL AND TESTAMENT. .'\. <br />"LAST WILL AND TESTAMENT OF SIMEON SAWYER. <br />I,Simeon Sawyer,of the city of Lincoln,Laneaster CountytNebraska,considering the uncertainty of <br />this mortal life and being of sound mind and memory do make,publish,and declare this to be my <br />last will and testament,that is to say: <br />First; - -Owing to the location of my property,I have concluded that it is for the best interests <br />of all concerned to convert same into cash and make disposition of same as hereafter provided.I <br />therefore direct that my just debts be paid out of my personal property as soon after my decease <br />as may be convenient. <br />Second : - -I give and bequeath to my wife Frances J.Sawyer all my household goods,wearing apparel, <br />and $200.00 in cash.1 also direct that she be paid a reasonable allowance during the settlement <br />of my estate and until my property is sold and. divided as hereafter provided. <br />Third : - -I direct that my executors,or administrators with the will annexed,sell and convert into <br />cash all the rest and residue of my property of whatsoever kind or nature and wheresoever situate <br />within three years after my decease;and I further direct that said executors or administrators <br />use their best judgement as to when said sale shall be made within said period ;and said property <br />whether real,personal,or mixed,may be sold by said executors or administrators either at private <br />or public sale as in their judgment will be for the best interests of said estate.Sgid executors <br />or administr&rs shall have full power to convey said property to the purchasers thereof and to <br />convey to them any and all real estate by good and sufficient deeds of conveyance. <br />Fourth : --- After my said executors or administrators have converted the residue of my said property <br />into cash as provided in paragraph third above,I direct and will that said residue be divided and <br />distributed as follows,to -wit: One -third thereof to my wife Frances J.Sawyer,which shall be in <br />lieu of all interest she might otherwise be allowed under the statutes of Nebraska;One -sixth <br />thereof to each of my said two sons Harland L.and Russell D.Sawyer;and One - twelfth thereof to each <br />on my four daughters,Lucy E.Searls,Lida J.Dumond,Mary ik.Brown,and Frances E.Sawyer;and <br />I further <br />SILEON SAWYER <br />direct and provide that ih <br />case <br />any of my children die before <br />me,leaving issue,then <br />and <br />in that <br />case his or her share shall <br />go <br />to and be paid to the issue of <br />my deceased child in <br />equal <br />shares; <br />and provided further that if any of my children shall die before me,leaving no issue,then I direct <br />that his or her share shall lapse and be and become a part of the residue of my estate and be <br />divided as such.And I further direct and provide that in case of my said wife Frances J.Sawyer <br />dies before me then the whole of the residue of my estate shall be divided among my sons and <br />daughters in the same proportions as fixed in paragraph third hereof,viz: Two parts to each son <br />and one part to each daughter,being two - eighths to each son and one - eighth to each daughter. <br />Fifth : -- I hereby nominate and appoint my wife Frances J.Sawyer and my daughter Frances E.Sawyer <br />as executors of this my last will hereby revoking all former wills by me made.In case either of <br />said executors for any reason fail,refuse or neglect to qualify as sueh,the remaining executor <br />may act alone,or the County Court may appoint a successor,and in case neither of said executors <br />qualify as such,or should resign or be discharged,then the County Court may appoint an administrat- <br />or or administrators with the will annexed,and any executor or administrkr with the will annexed <br />
