That, there has come into the hands of the administrator of said estate the sum of 42568.27, of which amount said administrator has expended the sum of $1421.28 in paying the debts and costs of administering said estate, leaving a balance in his hands as such administrator in the sum of $1146.gg. That, since the filing of the final report herein said administrator has expended for and on behalf of said estate, the following, to -wit: Greeley County Court, costs 463.16 T.J. Howard, Attorney fees, 40.00 Arthur Meyer, Administrator Expense 5.00 Greeley County Treasurer,taxes 133.70 Hall County Treasurer,taxes, Total, 25.00 2 which leaves a balance in the hands of said administrator for distribution of $880.13. That, said deceased left him surviving as his only heirs at law and next of kin, the following named persons, who are related to said deceased as herein stated, to -wit: Christena Wegner, widow, Henry Wegner, son, Anna Smith, daughter, Daniel Wegner, son, Martha Meyer, daughter, William Wegner,son, Esther Dunk61berger, daughter, and Ella Halm, daughter, who are all of legal age. That, said deceased was, at the time of his death, the owner in fee simple of the following described real estate, to -wit: ' The South Half (S-0 of the South West Quarter (34) of Section Sixteen (16), and the South East Quarter (SE0 of Section Seventeen (17),and ;the West Half (W2) of Section Twenty -one (21), all in Township Seventeen (17),North Range Eleven (11),West of the Sixth Principal Meridian, in Greeley County, Nebraska; and, Fractional Lot Six (6) and Westerly One -half of Lot Seven (71p, in Block Ten (10), Arnold & Abbott's Addition, and Fractional Lot Six (6) and Westerly One -half of Lot Seven (7), in Block Nineteen (19), Rollins Addition, all in the City of Grand Island,Hall County,Nebraska, and that the North West Quarter (NWJ) of Section Twenty -one (21), in Township Seventeen (17), North,Range Eleven (11),West of the Sixth Principal Meridian, in Greeley County, Nebraska, was occupied and used by the said Louis Wegner and his family as his homestead at the time of his death. That, the funeral expenses, expense of last sickness, costs of administration and all claims filed and allowed against said estate have been fully paid; that said estate or the interest of any of the heirs at law of said deceased therein are not liable for the payment of any Federal or State Inheritance Tax. That, the heirs at law of said deceased share in the distribution of said estate in the follow- ing proportions, to -wit: To Christena Wegner, widow, an undivided one -third interest in and to all of said estate, both real and personal, together with the right to the use of all of the North West Quarter (NWa) of Section 21, in Township 17, North,Range 11,West of the Sixth Principal Meridian, in Greeley County, Nebraska, during her natural life time. To Henry Wegner, son, Anna Smith, daughter, Daniel Wegner, son, Martha Meyer, daughter, William Wegner, son, Esther Dunkelberger, daughter, and Ella Halm, daughter, each an undivided two - twenty - first of said estate, both real and personal, subject, however, to the right of the widow of said deceased to the use of the homestead of said deceased. It is Therefore Ordered, Adjudged and Decreed by the Court: That, the final account filed herein on the 7th day of October, 1940, be, and the same hereby is, allowed and approved as the final account of said administrator. That, said estate be, and the same hereby is, set over and assigned in accordance with the Laws of Descent and Distribution of the State of Nebraska in the proportions herein found, to the following named persons, who are all and the only heirs at law and next of kin of said de- peased, and who are related to said deceased as herein stated, to -wit: Christena Wegner,widow,
