<br />principal or corpus of the same, and the income from and interest thereon, he shall pay annually,
<br />or at such times as to him may seem best, to Marion F.Frobese, or her order, mother of said grand-
<br />children, so long as she shall live and remain unmarried, but upon her marriage or death my said
<br />executor shall pay o ver said sum of money or any part thereof, remaining in his hands, one half
<br />to my daughter Antonio Kreisle of Travis County, Texas, her heirs and assigns, and the other one
<br />half shall pass to and vest in my son Bruno C.Leonardt, of DeWitt County, Texas, his heirs and
<br />assigns forever;-and sho 'Uld the said Bruno C.Leonardt, who has been by me hereinbefore named and
<br />appointed as the executor of this my last will and testament, be not then living, such sum or sums
<br />of money or property arising from the investment thereof then remaining shall be paid and delivered
<br />by the person or persons charged with the administration of my estate and the estate of the said
<br />Bruno C.Leonardt, to the heirs of the said Bruno C.Leonardt in accordance with the laws of Descent
<br />and Distribution of the State of Texas.
<br />Third. I give, devise and bequeathe unto my beloved childred Antonio Kreisle and Bruno C.
<br />Leonardt, share and share alike, all of the residue of the property, read, personal and mixed,
<br />of whatsoever kind and character, and wheresoever situated, of which I may die seized and possessed
<br />and to which I may be entitled at the time of my death, remaining after the payment of my just
<br />debts and the legacies as hereinbefore stipulated and provided, absolutely and in fee simple, to
<br />have and to hold the same unto them and their heirs and assigns forever.
<br />Fourth. I nominate and appoint my beloved son, Bruno C.Leonardt, independent executor of this
<br />my last will and testament, and direct that no bond or other security shall ever be required of
<br />him as such; and I do hereby authorize and empower my said executor, for the purpose of paying
<br />my just debts, partitioning my estate among the persons entitled thereto, and the property be-
<br />longing to the same, paying the legacies hereinbefore mentioned, and for any other purpose, when
<br />in his judgment it shall be best so to do, to sell, at public or private sale, and for cash or on
<br />credit, or partly on credit and partly for cash, and on such terms as to him may seem best, any
<br />property, real, personal or mixed, of whatsoever kind and character, and wheresoever situated,
<br />and especially in the County of Hall and State of Nebraska, and to make any and all deeds, with
<br />or without covenants of warranty and other conveyances of such property so sold, as may be neces-
<br />sary in equity or at law, hereby giving and granting unto him, my said exenutor, full right, power
<br />and authority to do and perform any and all acts necessary in and about the premises as aforesaid.
<br />Fifth. It is my will and desire, and I so direct, that no other action shall be had in the
<br />Probate Court, or any other Court, in relation to this my last will and Testament and the settle-
<br />ment, administration,management, and partition of my estate after my death, then to probate and
<br />record this my last will and testament and to return and have appraised an inventory of all of the
<br />property belonging to my estate and a list of claims against any and all persons who may be in -
<br />debted to me at the time of my death and to have the same recorded according to law.
<br />Sixth. In Testimony whereof, I have hereunto set my hand on this thirtieth day of January,
<br />A.D. 1928, in the presence of the undersigned witnesses, who in my presence, and in the presence
<br />of each other, attest the same at my request, and then and there I did publish and declare to
<br />them, and each of them, this to be my last will and testament.
