<br />children, as set forth in the next succeeding paragraph. The reason that I do not give the
<br />Starling children a greater amount is that I have heretofore paid out large sums for assistance
<br />to my deceased daughter and for their support and expenses.
<br />FIFTH: All of the rest, residue and remainder of my property of every kind and nature, I give,
<br />devise and bequeath to my sons, Wilhelm Matthiesen, of Grand Island,Nebraska, Henry Matthiesen
<br />of Doniphan, Nebraska, Julius Matthiesen,of Grand Island,Nebraska, and to my daughters, Augusta
<br />Knuth, of Grand Island,Nebraska, Rosa Hann of Grand Island,Nebraska, and Lillie Bennetsen of San
<br />Francisco, California, share and share alike.
<br />SIXTH: I name, nominate and appoint my wife, Christina Matthiesen, as Executrix of this my Last
<br />Will and Testament, and hereby revoke any and all former wills by me made. I hereby direct that
<br />my wife, Christina Matthiesen, shall not be required to give any bond as Executrix of my estate.

<br />I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on
<br />the 28th day of March, 1939, the instrument purporting to be the last will and testament of
<br />Julius Matthiesen,or., deceased, was filed for probate in this Court. That on the 20th day of
<br />April 1938, said instrument to which this certificate is attached was duly proved, probated and
<br />allowed as the last will and testament of the real and personal estate of said Julius Matthiesen,
<br />Sr., deceased, and the same was ordered to be recorded in the records of the Court aforesaid.

<br />and her discharge as executrix of said estate, and the Court having examined the records and
<br />files herein, including said report and vouchers thereto attached, and being fully advised in the
<br />premises finds as follows:

<br />deceased, filed her petition in this Court in which she alleged, among other things, that Julius
