<br />SECOND
<br />That on the 15th day of July,1939,Dorothy L.Augustine,widow of said Howard M.Augustine,filed in
<br />this Court a petition praying for the appointment of E.W.Augustine as Administrator of the Estate
<br />of said deceased; that on the 15th day of July,1939,an order of this Court was made therein,as-
<br />signing the 9th day of August,1939,at 10 o'clock A.M.at the County Court Room in said County as
<br />the time and place for hearing said petition,and ordering that notice be given to all persons in-
<br />terested in said matter by publishing a notice of said order in the Grand Island Independent,a
<br />legal newspaper printed in said county for three successive weeks prior to said day of hearing,
<br />and it appears by proof on file that notice of said order was given as ordered by this Court.
<br />THIRD
<br />The Court further finds that E.W.Augustine named in said petition was,upon his giving bond in the
<br />sum of $25,000.00 as ordered by this Court,appointed Administrator as prAyed; the Court further
<br />finds that the deceased at the time of his death was a married man and that he left the following
<br />heirs -at -law: Dorothy L.Augustine,his widow,Howard Lynn Augustine,his son,age 14,Ann Margaret
<br />Augustine,his daughter,age 9.
<br />FOURTH
<br />That on the 9th day of August,1939,an order of this Court was made allowing said administrator
<br />one year in which to administer said estate,and on the 18th day of August,1939,an order of this
<br />Court was made allowing creditors three months from the 13th day of September,1939,in which to
<br />file their claims against said estate and further ordering that a notice of the same be published
<br />in the Grand Island Independent,a legal newspaper published and circulating in Hall County,Nebras-
<br />ka,for three successive weeks prior to said 13th day of September,1939,and it appears by proof on
<br />file that notice of said order was published as ordered by this Court.
<br />FIFTH
<br />The Court further finds that on the 4th day of October,1939,the said E.W.Augustine,as Administra-
<br />tor,filed in Court his inventory of the property of said estate,and that according to said inven-
<br />tory,the deceased died seized. and possessed of the following described real estate,to -wit:
<br />The Easterly Twelve (E 16) feet of Lot Nine (9) and all of Lot Ten (10) in Block Seventeen (17),
<br />partly in Charles Wasmer's Addition to the City of Grand Island,Nebraska,and partly in Charles
<br />Wasmer's Third'Addition to Grand Island,Nebraska,
<br />An undivided one -sixth (1/6) interest in the following described real estate,to -wit: The East -
<br />erly One -third (E 1/3) of Lot Seven (7) and all of Lot Eight (8) in Block Sixty -seven (67) of the
<br />Original Town now City of Grand Island,Nebraska,also Lot Six (6) in Block Twelve (12) of Kernohan
<br />and Decker's Addition to the City of Grand Island,Nebraska,subject to a life estate therein in
<br />Alice T.Augustine,
<br />and chattel property listed in the approximate value of $42,101.59
<br />SIXTH
<br />The Court further finds that according to the laws of descent and distribution said property des-
<br />cends as follows; An undivided one -third (1/3) interest to Dorothy L.Augustine,an undivided one -
<br />third (1/3) interest to Howard Lynn Augustine,an undivided one -third (1 /3)-interest to -Ann Mar-
<br />garet Augustine,and a life estate in favor of said Dorothy L.Augustine in and to the Easterly
<br />Twelve (E 16) feet of Lot Nine (9) and all of Lot Ten (10) in Block Seventeen (17),partly in
<br />Charles Wasmer's Addition to the City of Grand Island,Nebraska,and partly in Charles Wasmer's
<br />Third Addition to Grand Island,Nebraska,that being the homestead of said deceased at the time of
<br />his death.
<br />SEVENTH
<br />The Court further finds that on the 9th day of August,1939,Carl E.Willard was appointed appraiser
<br />of said estate for inheritance tax purposes and after having taken oath as such appraiser and
<br />given notice as by law required,on November 14,1939,said appraiser filed his report with this
<br />Court,appraising said estate and finding an inheritance tax due the State of Nebraska in the sum
<br />of $119.95 from said estate,and on November 17,1939,an Order of this Court was made approving said
