<br />the property of the said Max L.Rich, if the said proposed marriage is consummated, that she other-
<br />wise would have, were it not for this ag! °eement; and
<br />WHEREAS, the said Max L.Rich has been married before, by which marriage he had eight children,
<br />of whom seven are now living, to -wit, Dorothy Lepant, Frances Spanel,Margaret Rich,Helen Rich,
<br />Isabelle Rich, Maxine Rich and Eduard Rich; the deceased child being Marie Wagner, who died leaving
<br />a minor child, Joseph Wagner, her Son, who is now living and of about the age of seven years; and
<br />WHEREAS, the accumulations set forth in Exhibit "A" were the ,joint accumulations of the said
<br />Max L.Rich and his first wife, Rose Ellen Rich, and of the said children of the said union, who
<br />jointly and severally cooperated with the said Max L.Rich, to accumulate the said property, which
<br />facts have been explained to the said Josephine Rita Klein and are now understood by her, and she
<br />agrees with the said Max L.Rich that such accumulations, morally and equitably, belong to the chil-
<br />dren of the previous marriage, and to such uses and purposes as the said Max L.Rich shall nut the
<br />said property for the benefit of said children and for charitable purposes in honor of his deceased
<br />wife and daughter; and
<br />WHEREAS, it has been mutually agreed by and between the parties hereto that in the event the
<br />said Josephine Rita Klein shall survive the said Max L.Rich as his lawful widow, she shall receive
<br />the sum of Ten Thousand Dollars ($10,000.00) and no more, in lieu of and in full satisfaction of
<br />all her rights in and to the property, and wheresoever situated, of which the said Max L.Rich shall
<br />die the owner, and in lieu of and in full satisfaction of all her dower rights, inheritance,home-
<br />stead, right of support and other statutory rights, she w -uld or might otherwise have or be en-
<br />titled to, of which the said Max L.Rich shall die the owner, but for these presents; the said sum
<br />of Ten Thousand Dollars ($10,000.00) to be paid to the said Josephine Rita Klein out of the estate
<br />of the said Max L.Rich within one year after the death of the said Max L.Rich.
<br />IOW, THEREFORE, IN CONSIDERATION of the premises and of the mutual promises and agreements
<br />herein contained, and in consideration of the intermarriage of the said Josephine Rita Klein and
<br />Max L.Rich, in the event of the consummation of the said proposed marriage between the parties
<br />hereto, and of the said Josephine Rita Klein surviving the said Max L.Rich, as his lawful widow,
<br />and in consideration, as aforesaid, the said Josephine Rita Klein specifically waives any such
<br />rights, as hereinbefore enumerated in and to all his property, both real and pers=j, which the
<br />said Max L.Rich now has or may hereafter acquire, except the sum of Ten Thousand Dollars ($10,000.00)
<br />and the said Josephine Rita Klein agrees to accept said sum in lieu of and in full satisfaction of
<br />any and all the rights, title, estate, claim or demand, including homestead, or right of support,
<br />or any other statutory right, both at law and in equity, she might or otherwise would have in and
<br />to the property and estate of the said Max L.Rich, were it not for this Ante Nuptial Agreement,said
<br />sum to be paid to the said Josephine Rita Klein in the manner hereinbefore provided; and in consid-
<br />eration of the premises, and of the intermarriage of the parties hereto, and of the said sum to
<br />her to be paid, upon the conditions and in the manner hereinbefore provided, the said Josephine
<br />Rita Klein hereby releases Max L.Rich from any and all claim, demand,right,title,interest, home-
<br />marriage of the parties hereto.
<br />It is further agreed by and between the parties hereto that in the event conditions shall arise
<br />making it impossible for the parties hereto to live together as husband and wife, or in the event
<br />the parties hereto shall separate, or that either,party shall obtain a divorce from theother, or
<br />any other event or condition arises whereby these parties cease to live together as husband and wife,
<br />stead, dower, inheritance, right of
<br />support, and other estate, both at law
<br />and in equity,
<br />to which
<br />she, the said Josephine Rita Klein,
<br />might or would be entitled as the wife
<br />and surviving
<br />widow of
<br />the said Max L.Rich, were it ndt for
<br />these presents; and in consideration,
<br />as aforesaid,
<br />the said
<br />Josephine Rita Klein specifically waives
<br />any such rights, as hereinbefore
<br />enumerated, in
<br />and to
<br />all his property, which the said Max
<br />L.Rich now has or will h. -ve up to the
<br />consummation of
<br />the
<br />marriage of the parties hereto.
<br />It is further agreed by and between the parties hereto that in the event conditions shall arise
<br />making it impossible for the parties hereto to live together as husband and wife, or in the event
<br />the parties hereto shall separate, or that either,party shall obtain a divorce from theother, or
