THE AUGUSTINE CO. 18600 -12.86 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUN`rY,NEBRASKA. <br />In the Matter <br />^f the i FINAL DECREE <br />Estate of Max L.Rich, <br />Deceased. <br />Now on this 28 day of June, 1940, this cause came on to be heard upon the Final Report of Frank <br />J.Cleary, Administrator of the estate of said Max L.Rich, deceased; and the Court, after having <br />examined the records and files in this case finds that there are no objections on file to the <br />allowance of said Final Report. <br />The Court further finds that all matters in dispute have been settled and orders aporoving <br />settlements have been entered by this court. <br />The Court further finds, after having examined said Final Report and the records and files <br />in this estate, that said Final Report is in all things true and correct; that the Administrator <br />has therein accounted for all the assets of the estate which have come into his knowledge or pos- <br />session, and that he has disbursed seid assets in accordance with the orders of this Court, and <br />that said Final Report should be apnroved. <br />IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the Final Report of Frank J. <br />Cleary,Administrator, be and the same is hereby approved. <br />The Court further finds that all claims filed in the estate have been paid in full; that the <br />time fixed for filing claims has long since elapsed; <br />nature, character and extendt of which the said Josephine Rita Klein is familiar; and considering <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that all claims now on file be and <br />just or equitable that the said Josephine Rita Klein should have or receive the rights in or to <br />the same are hereby forever barred. <br />The Court further finds that all claims allowed have been paid in accordance with the orders <br />of this Court; that the expenses of administration and funeral expenses have been paid in full; <br />that said estate i,,7as not subject to State inheritance tax; that the Federal estate tax has been <br />paid; and that there is a balance on hand of $163.57 in the hands of the Administrator for dis- <br />tribution. <br />The Court further finds that the Administrator has paid to Josephine Rich as Guardian of <br />Joanne Rich, a minor, the sum of $2,250.00, as provided for in the stipulation and agreement for <br />settlement and order anvroving,settlement and receipt filed therefor. <br />The Court further finds that on or abou t the 15th day of April, 1925, the deceased enter <br />into an Ante Nuptial Contract with Josephine Rita Klein; that, thereafter, the said Max L.Rich <br />did intermarry with the said Josephine Rita Klein, and that she survived him as his widow, she <br />being the person des ignated in this estate as Josephine Rich, which Ante Nuptial Contract <br />is in words and figures as follows, to -wit: <br />"THIS ANTE NUPTIAL CONTRACT AND AGREEMENT, Made and entered into this 15th day of April,A.D., <br />1925, by and between Max L.Rich, widower, of Hall County, Nebraska, party of the first part, and <br />Josephine Rita Klein, Spinster, of the same place, party of the second part, WITNESSETH: <br />WHEREAS, the said Max L.Rich and Josephine Rita Klein have agreed one to marry the other, upon <br />the condition, however, of the execution and delivery of an Ante Nuptial Agreement, declaring and <br />fixing the rights of the said Josephine Rita Klein in and to the property of the said Max L.Rich, <br />as his wife, and his widow, in the event she survives him as such; and <br />WHEREAS, the said Max L.Rich is the owner of considerable property, both real and personal, <br />an itemized list of the same being hereto attached marked "Exhibit A" and made a part hereof, the <br />nature, character and extendt of which the said Josephine Rita Klein is familiar; and considering <br />the respective ages of the parties hereto and the circumstances surrounding them, it is not ddemed <br />just or equitable that the said Josephine Rita Klein should have or receive the rights in or to <br />
