<br />It apr)earing from the records and files in said matter that notice of the time and place fixed
<br />for the hearing on said petition has been given by publication thereof as by order of said court
<br />heretofore made and entered, whereupon the heirs present, and Alfred Behrens, by his attorney,
<br />were sworn and testified. On consideration of the evidence the court finds that said Florence
<br />Behrens departed this life intestate on the 28th day of April, 1937; that said Florence Behrens
<br />was at the date of her death a resident of Hall County, Nebraska and died seized of an estate of
<br />inheritance in the following described real estate:
<br />South one half (Sj) of the North East Quarter (NE4) of Section 13, Township 10,Range 9, con-
<br />sisting of 90 acres in the County of Hall, Nebraska.
<br />that more than two years have elapsed since the date of the death of the said Florence Behrens,
<br />and no application for the appointment of an administrator of her estate has been made in this
<br />state by any heirs or persons claiming to be creditors of said deceased. That the Only legal
<br />heirs of the deceased are the following:
<br />Alfred Behrens, surviving spouse, Grand Island.
<br />Mrs. Francis Behrens Cole, daughter, Grand Island.
<br />Mrs.Fa.y Behrens Schwartz, daughter, Wood River
<br />Fern Behrens, daughter, Grand Island
<br />William Behrens, son, Grand Island.
<br />That all heirs excepting Fern Behrens and William Behrens are of legal age.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED that the above described real estate by assigned,
<br />free and clear of all debts, as follows: to the said Alfred Behrens, a one -third interest therein,
<br />and the remaining two - thirds to be divided equally between Mrs.Fra.ncis Behrens Cole, Mrs„ Fay
<br />Behrens Schwartz, Fern Behrens and William Behrens, as her only surviving heirs and that all
<br />claims of any and all creditors shall henceforth be forever barred.

<br />Behrens appeared by Jeannette Crawford, his attorney, together
<br />with Mrs. Francis
<br />Behrens Cole,
<br />Mrs. Fay Behrens Schwartz and Fern Behrens, all heirs of the de-
