<br />In the Matter of the Estate )
<br />of FINAL DECREE
<br />Feder R.Birk,deceased
<br />This cause came on for hearing upon the Final Report of Agnes A.Birk,Administratrix,and for dis-
<br />tribution of the personal property belonging to said estate,and assignment of real estate.
<br />The Court having examined the.records and files,and being duly advised in the premises,finds
<br />that Feder R.Birk died intestate on the 25th day of August,1933,that at the time of his death he
<br />was an inhabitant and resident of Hall County,Nebraska.That he1left surviving him the following
<br />heirs at law:
<br />Agnes A.Birk,his widow.
<br />nary Jean Birk,a daughter,
<br />Barbara Birk,a daughter,
<br />and that on the 7th day of September,1933,a petition was filed herein for the administration of
<br />the estate of Feder R.Birk;that due and legal notice was given fixing the date for hearing upon
<br />said petitio+ad h;- ,pursuance thereof on the 7th day of October,1933,Agnes Birk was appointed
<br />Administratrix of the estate of Feder R.Birk,deceased,and qualified as such.
<br />The Court finds that due and legal notice of the time and place of hearing the final report of
<br />said Administratrix and petition for discharge has been given to all persons interested in said
<br />estate as provided by law.
<br />The Court being fully advised in the premises finds:
<br />That the final report of Agnea A.Bifk,Administratrix of said estate,i:& in all respects just,true
<br />and correct ;that notice has been given to creditors of the time for filing claims,and that the
<br />time for filing claims has expired,and that all claims allowed against said estate, including
<br />the expense of administration,have been paid and satisfied.
<br />The Court further finds that said heirs at law,Mary Jean Birk and Barbara Birk are of legal age
<br />and have filed their written assignments herein assigning all of their right,title and interest
<br />in and to the personal property to Agnes A.Birk,and by virtue thereof all of the personal property
<br />in the hands of said Administratrix belonging to said estate is to be assigned and transferred
<br />by said Administratrix to Agnes A.Birk.
<br />The Court further finds that said Feder R.Birk died seized of the following described real estate:
<br />The Westerly Half of Lot Two (2) and the Easterly Half of Lot Three (3), in Block Thirteen (13), of
<br />Charles Wasmer's Addition to the city of Grand Island, in Hall County, Nebraska, as surveyed,
<br />platted, and recorded, said two halves forming together a rectangular piece of ground having a
<br />frontage of 52 feet on Division Street and a depth of 132 feet.
<br />That said real estate was occupied by said deceased at the time of his death with his family as
<br />their home and constitutes the homestead; that by reason thereof the surviving widow, Agnes A.Birk
<br />has a life estate in said real estate, and subject to said life estate said premises passed under
<br />the laws of descent of the State of Nebraska, one -third to Agnes A.Birk, and one -third each to Mary
<br />Jean Birk and Barbara Birk, daughters and heirs at law of said Feder R.Birk.
<br />The Court further finds that there was no Inheritance Tax to be paid on said estate.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the final report of Agnes A.Birk,
<br />Administratrix of the estate of Feder R.Birk, deceased, be and the same is hereby approved and
<br />allowed as and for her final report, and said Administratrix is hereby discharged and her bond
<br />released, and said estate is hereby settled and closed.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that all persons having claims against
<br />the estate of Feder R.Birk, deceased, and not filed herein, if any such there be, are forever
<br />barred, and are enjoined and precluded from setting up or asserting such claims against said
<br />estate.
