<br />thence South along said East Alley Line Three Hundred Ninety -one and Fifty -one Hundredths
<br />(391.51) feet to the place of beginning, subject to Legal Highways.
<br />11. Lot Four (4) in Block Eleven (11) in the Village of Cairo, Hall County, Nebraska.
<br />3. That no application has been made in the State of Nebraska for the appointment of an ad-
<br />ministrator of the estate of said deceased.
<br />4. That due notice was given to creditors, that no claims were filed against the estate, and
<br />that all persons are forever barred and precluded from filing or setting up any claims against the
<br />estate of Miriam R.Gardner, deceased; and that all of the claims and obligations existing against
<br />the said estate have been paid.
<br />5. That this estate is not subject to any federal or state inheritance taxes.
<br />6. That the said Miriam R.Gardner, deceased, was also known as Miriam R.Gardner, and also
<br />as Minnie.R.Gardner; but that she was one and the same individual notwithstanding the discrepancy
<br />in names.
<br />7. The Court further finds that the said William E. Gardner, incompetent herein, was also
<br />known as William Elmer Gardner; but that he is one and the same individual notwithstanding the
<br />discrepancy in names.
<br />8. That the said Miriam R.Gardner, deceased, died intestate on the 2nd day of March, 1919,
<br />being at the time of her death a single woman with no immediate family of any husband or children;
<br />and that her sole and only heir at law, and the only person interested in her estate, is the fol-
<br />lowing:William E.Gardner, her brother, more than twenty -one (21) years of age.
<br />This Court further finds that at the time of the death of the said Miriam R.Gardner, deceased, the
<br />above described property descended to the said William E.Gardner, an incompetent.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the said Miriam R.Gardner,
<br />also known as Mariam R.Gardner and Minnie R.Gardner, died intestate on the 2nd day of March, 1919,
<br />leaving surviving her as her sole and only heir at law, William E.Gardner, also known as William
<br />Elmer Gardner, an incompetent, her brother.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all of the property.owned by
<br />the said deceased did descend at the time of her death, namely, the 2nd day of March, 1919, to
<br />the said William E.Gardner; and that the said real estate consisted of the following described
<br />property, all of which is situated in Hall County, Nebraska, to -wit:
<br />1. An undivided one -half interest in the following:
<br />(a) South half (S-2) of Lot Three (3) in Block Eleven (11) in the Village of Cairo,
<br />Hall County, Nebraska.
<br />(b) A part of Section Nineteen (19), in Township Twelve (12), North of Range Eleven
<br />(11), West of the Sixth (6th) Principal Meridian, more particularly described as
<br />follows : - Commencing at a point Twenty (20) feet east of the southeast corner of
<br />Block Numbered Six (6), of the Third addition to the Town of Cairo, (according
<br />to the recorded plat thereof); thence -east in the continuation of the North Line
<br />of Nile Street of said Town, One Hundred Forty (140) feet; thence North at right -
<br />angles to said North Line, Three Hundred Fifty -two and Six Tenths (352.6) feet,
<br />to a point Eighty (80) feet distant at right - angles and southerly from the Center
<br />Line of the main track of the Chicago,Burlington, and Quincy Railraod; thence North
<br />740 28' West, parallel with said Center Line of Railroad, One Hundred Forty -five
<br />and Thirty -one Hundredths (145.31) feet, to Intersect the East Line of the alley
<br />running; east of said Block Numbered Six (6); thence South alon said East Alley
<br />Line Three Hundred Ninety -one and Fifty -one Hundredths (391.51 feet to the place
<br />of beginning, subject to Legal Highways.
<br />11. Lot Four (4) in Block Eleven (11) in the Village of Cairo, Hall County, Nebraska.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all claimB and demands against
<br />the estate of the deceased either due or to become due, whether absolute or contingent, be and
<br />the same are hereby forever barred.
<br />Costs in this estate total $36.78, which have herewith been paid in full this date.
