<br />NOW on this 20th day of March, 1940, this matter came on for hearing upon the petition of
<br />Hendrick B.Paine and Ira E.Paine, duly appointed, qualified and acting guardians of William E.
<br />Gardner, an incompetent, and the evidence was submitted to the Court, on consideration whereof
<br />the Court finds that due and legal notice of this proceedings has been given to all persons in-
<br />terested in said matter, both creditors and heirs, as required by law. The Court being fully
<br />advised in the premises further finds as follows:
<br />1. That all of the statements and allegations set forth in said petition are true; that
<br />more than two years have elapsed since the death of the said Miriam R.Gardner, deceased; that
<br />the said Miriam R.Gardner died intestate in Hall County, Nebraska, on the 2nd day of March, A.D.,
<br />1919, being-at the time of her death a resident of Hall County, Nebraska.
<br />2. That the said Miriam R.Gardner, deceased, was seized and possessed as the fee owner at
<br />the time of her death, of the following described real estate all of which is situated in Hall
<br />County, Nebraska, to -wit:
<br />1. An undivided one -half interest in the following:
<br />(a) South half (S2) of Lot Three (3) in Block Eleven (11) in the Village of Cairo, Hall
<br />County, Nebraska.
<br />(b) A part of Section Nineteen (19), in Township Twelve (12), North of Range Eleven (11)
<br />West of the Sixth (6th) Principal Meridian, more particularly described as follows: -
<br />Commencing at a point Twenty (20) feet east of the southeast corner of Block Numbered
<br />Six (6) of the Third Addition to the Town of Cairo,(according to the recorded plat
<br />thereof ; thence east in the continuation of the North Line of Nile Street of said
<br />Town,, One Hundred Forty (140) feet; thence North at right- angles to said North Line,
<br />Three Hundred Fifty -two and Six - tenths (352.6) feet, to a point Eight (80) feet dis-
<br />tant at right - angles and southerly from the Center Line OT the main track of the
<br />Chicago, Burlington, and Quincy Railroad; thence North 740 28' West, parallel with
<br />said Center Line of Railroad One Hundred Forty -five and Thirty -one Hundredths (145.31
