<br />James E.Hitt, deceased )
<br />Now on this 21st day of February, 1940, this cause came on for hearing before the Court upon
<br />the Final Account of Clinton E.Cronin, Administrator of the estate of the said James E.Hitt, de-
<br />ceased, with the will annexed, and upon his petition for distribution. Thereupon evidence was
<br />duly introduced and the Court being fully advised in the premises finds from the evidence and from
<br />a careful examination of the said final account that the same is true-and c.orreett;in all respects
<br />and should be approved and confirmed by the Court and the said Administrator discharged from his
<br />trust.
<br />The Court further finds that the said James E.Hitt departed this life at Costa Mesa, California
<br />on March 4, 1938, being at the time of his death a resident and inhabitant of Campbell County,
<br />Wyoming. That thereafter the Last Will and Testament of the said James-E.Hitt was duly admitted
<br />to probate in the District Court of Campbell County, Wyoming, and a duly authenticated copy there-
<br />of, with the probate attached thereto, filed in this Court and thereafter, upon due and legal notice
<br />to all persons interested in said - estate, duly admitted to probate herein.
<br />The Court further finds that all proceedings have been had in the foregoing estate for the
<br />filing and allowance of claims; that a time and place for filing said claims has been duly fixed
<br />by the Court and due notice thereof given to all creditors and other persons interested in said
<br />estate; that said time has elapsed; that no claims have been filed in Nebraska against the said
<br />estate, and that all debts,claims and demands should be and are hereby forever barred and fore-
<br />closed.
<br />The Court further finds that there was no personal property belonging to the said estate and
<br />situated in the State of Nebraska that has come to the knowledge or possession of said Adminis-
<br />trator, that the rentals upon the real estate hezeinafter described, if any, have been collected
<br />by Charles G.Hitt, of Gillette, Wyoming, Executor of the estate of the said James E.Hitt under the
<br />said last will and testament, by appointment in the said District Court of Campbell County,Wyoming,
<br />and that no rentals or other moneys have been collected or received by the said Clinton E.Cronin,
<br />Administrator with the will annexed in the State of Nebraska.
<br />That all expenses of administration in Nebraska have been advanced and paid by the legatees
<br />and devisees named in the last will and testament of the said'James E.Hitt, and that the said
<br />estate is not subject to the payment of Inheritance Taxes to the State of Nebraska.
<br />The Court further finds that the said James E.Hitt died seized of the following described
<br />real estate situated in the State of Nebraska, to -wit:
<br />South 55 feet of Fractional Lot 4 in Fractional Block 19, Kernohan & Decker's Addition to
<br />Grand Island, and of Fractional Lot 4 in ractional Block 19 of Palmer's Subdivision of
<br />Lot 7 of the County Subdivision of the Southeast Quarter of the Southwest Quarter of
<br />Section 16, Township 11, North of Range 9, West of the 6th P.M., Hall County,Nebraska;
<br />The Southwest Quarter of Section 1, the Northeast Quarter of Section 11, West Half of the
<br />East kalf of the Northwest Quarter of section 12, and the West Half of the Northwest Quarter
<br />of Section 12, all in Township 18, North Range 57,West 6th P.M. in Banner County, Nebraska;
<br />Lots Six (6), seven (7), Eight (8), and Nine (9) of Block Twenty (20) of the Town of
<br />Harrisburg, Banner County, Nebraska.
<br />The Court further finds that by the terms of the last will and testament the said tract of
<br />real estate in Banner County, Nebraska, was devised to
<br />Maude Potteroff, of St. Joseph, Missouri,
<br />Clara Ryan, of St. Joseph, Missouri, and
<br />Josie Kraft of Culver City, California,
<br />formerly of E1 Centro, California,
<br />in equal undivided shares, and that the remainder of said real estate was devised to
<br />Lucy Clay, of Belvidere, Nebraska,
<br />Charles G.Hitt, of Gillette, Wyoming, and
<br />Grace Kesel, of Costa Mesa, California,
<br />in equ�.l:`undivided shares.
